영국 항소법원은 유령선 사기와 관련된 The Prestrioka사건에서 ICC(A)의 창고간약관이 편입된 해상적하보험증권상 위험개시의 문제에 대하여 중대한 판단을 내린 바 있다. 동 법원은, 항해보험이라는 해상적하보험의 특성상 보험증권에 창고간약관이 편입된 경우라고 하더라도 선박이 보험증권에 특정된 목적지가 아닌 다른 곳으로 출항한 경우, 영국해상보험법(1906) 제44조에 따라 위험이 개시되지 않는다는 이유로, 보험자의 손해보상책임이 인정되지 않는다고 판결하였다. 따라서 본 논문은 The Prestrioka사건 판결의 문제점을 분석하고, 유령선 사기로부터 선의의 피보험자를 보호할 수 있는 실무적 해결방안을 제시한다.
Abstract
In the Prestrioka in relation to phantom ship frauds, the English Court of Appeal was confronted with the crucial issue on the attachment of risk under marine cargo insurance policy incorporating the warehouse to warehouse clause of the ICC(A). The court ruled in this case that, in the context of marine cargo insurance under the voyage policy, the risk did not attach under section 44 of MIA(1906) and the insurer was not liable for the loss, where the ship saild for a destination other than that specified in the policy, even where the warehouse to warehouse clause was incorporated in the policy. This article, therefore, analyzes some problems of the court's decision in the Prestrioka, and suggests practical solutions to protect the innocent assured against phantom ship frauds.
