루소는 사회계약을 통해 개인이 일반의지에 복종함으로써 진정한 자유를 얻는다고 주장한다. 루소는 일반의지에 복종하는 계약의 주체를 합리적 행위자로 상정한다. 이는 계약을 체결하고 준수하는 주체들이 이성적 대화가 가능한 합리적 행위자들이라는 것을 의미한다. 그러나 만일 계약 당사자들이 도덕적 행위자들이 아니라면 그들 간의 의사소통은 신뢰할 수 없다. 도덕적으로 정당화될 수 있는 사회계약을 위한 가능한 조건은 합리적인 의사소통 행위자들의 도덕성과 진실성이다. 민주적 의사결정 과정에서 의사소통 권력을 배제한다는 것이 불가능하다면, 루소적 의미에서 일반의지에 일치하는 사회계약을 통해 민주주의를 옹호한 루소의 시도는 성공할 수 없다. 이러한 해석에 따르면, 루소적 관점에서 민주주의의 성공은 민주적 공론장의 참여자들이 의사소통 권력의 영향으로부터 자유로워야 하며, 동시에 합리적인 도덕적 행위자일 수 있느냐에 달려 있다.
Abstract
Rousseau argues that through the social contract, individuals attain true freedom by submitting to the general will. He assumes that the subjects of the contract who submit to the general will are rational agents. This means that the parties entering into and upholding the contract are rational communicative agents capable of engaging in reasonable dialogue. Furthermore, if the contracting parties are not moral agents, communication between them cannot be trusted. The conditions necessary for a morally justified social contract include the morality and sincerity of these rational communicative agents. If it is impossible to exclude communicative power from the democratic decision-making process, then Rousseau's attempt to defend democracy through a social contract aligned with the general will, in the Rousseauian sense, cannot succeed. According to this interpretation, from a Rousseauian perspective, the success of democracy depends on whether the participants in the democratic public sphere can be free from the influence of communicative power while also being reasonable moral agents.
