자율주행자동차에 관한 법적 문제

Abstract

Since the development of autonomous vehicles is being accelerated around the world, the importance of laws and regulations related to autonomous vehicles is also being emphasized accordingly. In this situation, the legal issues according to the introduction of autonomous vehicles were reviewed and the legislative directions of related laws were presented based on the findings in this study. The legislative directions presented in this study are as follows. First, the Road Traffic Act that considers a driver who is a person as the requirement should be amended. Second, the current driver’s license system should be significantly revised and improved into the license system that fits the autonomous vehicles. Third, the safety standards that fit the autonomous vehicles should be secured. Fourth, the system that can verify the performance of vehicle and the observation of safety standards established by the government should be prepared. Fifth, if a defect has occurred in the autonomous vehicles, the autonomous vehicles should be recalled actively. Sixth, the laws related to criminal law based on non-autonomous vehicles should be amended. Seventh, a legislative solution to impose responsibility directly to vehicle manufacturer such as inclusion of a computer program defect in the subject of Product Liability Act is necessary. Eighth, the obligation of autonomous vehicle owners and passengers to take out an automobile insurance should be maintained as it is now, and the obligation to take out an automobile insurance should be also imposed to any company which engages in the system of autonomous vehicles. Ninth, handling of data collected in the process of driving should be restricted strictly.
