Abstract
Since its initial introduction in the United Kingdom in 2016, the regulatory sandbox has been actively utilized as an important institutional tool, and has similarly served as a key system in Korea since 2019. Nevertheless, the precise meaning and legal definition of the regulatory sandbox remain unclear. In this regard, the regulatory sandbox can generally be defined as “a system that promotes innovation by easing regulatory environments in various ways to allow experimental implementation of innovative business models.” This definition enables a clear distinction from other systems and embraces the broader concept of regulatory sandboxes as they have spread globally. In the Korean context, the regulatory sandbox can be legally defined as “a system that facilitates innovation by promptly resolving regulatory uncertainties, or by granting exceptions to existing regulations where their direct application would be unreasonable, thereby allowing experimental implementation of businesses utilizing new technologies under a relaxed regulatory environment.” This definition adequately encompasses all regulatory sandboxes currently operated in Korea. As the regulatory sandbox model spread rapidly worldwide from its origin in the UK, each country adapted it to suit its specific environment. Despite such variations, regulatory sandboxes can generally be classified based on two dimensions: whether they designate specific fields for innovation (individual-type vs. integrated-type) and whether the primary driving entity is businesses or the government (application-based vs. participation-based). Based on this classification, the Korean regulatory sandbox can principally be analyzed as an integrated and application-based model. However, to mitigate the drawbacks of each type, Korea has supplemented its system by adding elements of individual-type and participation-based models. This approach can be seen as a desirable means to enhance the effectiveness of the regulatory sandbox, and there is a continuing need to expand the application of the individual-type model. However, there are limits to expanding regulatory sandboxes indefinitely through individual legislative acts. In the short term, it is necessary to establish a centralized agency to systematize and organize the frameworks and procedures of the various regulatory sandboxes. In the long term, based on the accumulated experience of diverse regulatory sandbox operations, it would be ideal to consolidate individual legislative frameworks into a unified regulatory sandbox law, under which an integrated, dedicated agency would manage the operation of regulatory sandboxes. This represents the ultimate direction that should be pursued.
