Abstract

In the changing digital platform environment, this study attempted to examine various legal issues and conflict cases related to the medical advertisement review system under the Medical Service Act, and to find solutions to them. As the position of the Medical Association, which emphasizes self-regulatory authority, and the government's position to strengthen regulatory authority are conflicted, and areas where it is ambiguous whether or not medical advertisement is subject to preliminary review have emerged, it was necessary to first consider whether self-regulation of medical advertisements is recognized in Medical Association, and if so, what are their scope and limitations. In order to guarantee freedom of expression, the preliminary review system by the Voluntary Review Agency was introduced in accordance with the purpose of the Constitutional Court's decision that the independence of the medical advertisement preliminary review organization should be secured from administrative agencies, but in reality, only medical professionals operate the Voluntary Review Agency. If the operation of the preliminary review system violates the constitutional limitations, functional limitations, and territorial limitations of self-regulation, revision of self-deregulation norms or government supervision may be required. Considering the controversy over self-regulation authority, it should be resolved legislatively by reaffirming the original purpose of the decision for the Constitutional Court. Under the current law, medical advertisements are self-regulations and need to be divided into a preliminary review system under the Medical Service Act and a comprehensive post-regulation under the Representation and Advertising Law. Currently, the main problems related to medical advertisement regulation in the digital platform environment are influencer advertisements, user reviews, blog advertisements, and advertising activities of medical advertisement platforms. If this is dealt with in the comprehensive context of platform advertising regulation, it seems that the conflict over preliminary review can be substantially resolved.
