인공지능은 국가안보의 중요한 수단이면서 기술주권, 소버린AI 논의처럼 국가 경쟁력과 산업진흥의 핵심요소로서경제안보 측면에서 중요성이 높아지고 있다. 미국과 중국간의 기술패권을 두고 벌어지는 일련의 분쟁은 관세 부과와보복 조치 등 무역 분쟁, 통상 대립으로 볼 수 있지만 종국에는 경제안보, 기술안보 등 국가안보와 미래의 기술패권을두고 벌어지는 총성없는 패권전쟁이라 할 수 있다. 이 글은 미국과 중국 간의 인공지능을 두고 벌어지는 기술패권 경쟁에서 미국의 인공지능 규제 가운데 최근 제⋅개정된 법률과 하위규정, 행정명령을 살펴보고자 한다. 미국인공지능의 규제 및 수출통제 정책 현황과 이에 가장 밀접하게 관련된 인공지능 실행계획(AI Action Plan)과 개정 수출통제개혁법(ECRA)에 논의를 집중하고자 한다. 먼저 트럼프 1기 행정부, 바이든 행정부, 트럼프 2기 행정부의 인공지능 행정명령과 최근 제정된 주 정부의 인공지능법 등 미국 인공지능 규제와 수출통제 정책 현황을 개괄적으로 살펴본다. 다음으로 인공지능 실행계획과 개정 수출통제개혁법 등 최근 미국 인공지능기술 수출통제 정책 주요내용을 검토한다. 인공지능 규제 중 수출통제 정책이 갖는함의로서 인공지능 규제와 수출통제 정책의 평가, 인공지능규제와 수출통제의 관계 등을 쟁점별로 검토한다. 마지막으로 미국 인공지능 규제와 수출통제 대응을 위한 법정책적제언을 제시한다.
Abstract
Artificial intelligence (AI) is a crucial tool for national security, and its importance is growing in economic security, as evidenced by discussions on technological sovereignty and sovereign AI, a key element of national competitiveness and industrial development. The ongoing disputes between the United States and China over technological hegemony can be viewed as a trade dispute or trade war, with tariffs and retaliatory measures. However, ultimately, it can be seen as a silent war for hegemony, centered on national security, including economic and technological security, and future technological hegemony. This paper examines recently enacted and revised federal laws, subordinate regulations, and executive orders within the U.S. AI regulatory landscape within the U.S.-China competition for technological hegemony. The discussion focuses on the current state of U.S. AI regulation and export control policies, most closely related to the recent AI Action Plan and the revised Export Control Reform Act (ECRA). First, we provide a comprehensive overview of U.S. AI regulations and export control measures, including the AI executive orders issued during the Trump administration's first, Biden administration, and Trump administration's second, as well as recently enacted state AI laws. Next, we review key elements of recent U.S. AI technology export control policies, including the AI Action Plan and the revised ECRA. We examine the implications of export control policies within AI regulation, focusing on issues such as evaluating AI regulations and export control policies, and the relationship between AI regulations and export controls. Finally, we offer legal and policy recommendations for responding to U.S. AI regulations and export controls.
