본 연구는 인공지능(AI) 산업의 성장과 규제 간의 균형을 위한 법적･제도적 방안을 제시한다. 인공지능 기술이 글로벌 경제 및 사회에 미치는 영향력이 증대되는 가운데, 국내 AI 산업의 국제 경쟁력을 강화하는 법적 틀의 필요성이 강조된다. 본 연구는 규제의 대상이 되는 국내외 AI 기업의 발전 및 국내 AI 경쟁력 확보가 우선임을 제시하며, 과도한 초기 규제를 지양하고 AI 기술의 혁신 촉진 및 국제 표준과의 동기화를 통해 대한민국이 글로벌 AI 산업에서 선도적 역할을 할 수 있는 점진적 규제 체계를 제안한다. 이를 통해 인공지능 주권을 확보하고, 사회적 가치와 지속 가능한 AI 산업 성장 동력을 조화롭게 발전시킬 수 있는 법적 기반을 마련하고자 한다.
Abstract
This study proposes legal and institutional measures to balance the growth and regulation of the artificial intelligence(AI) industry. The increasing influence of AI technology on the global economy and society emphasizes the need for a legal framework that strengthens the international competitiveness of the domestic AI industry. This study suggests that the development of domestic and foreign AI companies subject to regulation and securing domestic AI competitiveness should be prioritized, and proposes a progressive regulatory framework that can enable Republic of Korea to play a leading role in the global AI industry by avoiding excessive initial regulation, promoting innovation in AI technology, and synchronizing with international standards. By doing so, it aims to secure AI sovereignty and lay the legal foundation for the harmonious development of social values and sustainable AI industry growth engines.
