본 논문은 1990년대 이후 현재에 이르는 이주노동자 정책을 살펴보면서 정 책 형성과 변화의 인과적 기제를 밝히고자 한다. 본 논문은 한국의 이주노동자 정책을 “이주노동자를 합리적인 계약이나 정치적 인정의 평등적 관계 대신에 보호의 대상으로 취급하며 문제를 해결하려는” ‘온정주의적(paternalist) 정책’으로 정의한다. 본 논문은 정책 영역(policy domain)과 정책 패러다임(policy paradigm)에 의해 정책이 형성된다는 이론적 견지에서 온정주의적 이주노동자 정책의 형성과 변화를 검토한다. 특히 본 논문은 인정의 정치(politics of recognition)에 기반 한 다문화 정책이 국가와 사회집단 간의 인종·종족 동학을 통해 도출되는 인종·종족 기획이라고 보고 이를 정책 형성의 이론과 결합시켜 한국의 온정주의적 이주노동자자 정책의 기제를 분석한다. 1990년대 이주노동자 정책의 개선 과정에서 이주노동자 운동의 조직화가 이루어졌고 이 들 중 일부는 인권과 노동권을 넘어서 소수자 집단으로서의 고유한 정체성과 권리를 요구하는 인정의 정치를 표방하였다. 그러나 2003년 이후 정부가 본격 적인 이주노동자 정책을 실행해갈 때 이주노동자의 자결조직이 표방한 인정의 정치는 정책 영역과 정책 패러다임에서 배제됐다. 정부는 이전까지의 정책 영역에서 안정적 관계를 구축한 지원 단체들과의 협력을 통해 ‘관용’의 패러다임에 기반한 교육, 선교, 가족, 공동체 지원 중심의 복지정책을 추진하였고, 이는 결과적으로 온정주의적 이주노동자 정책의 형성으로 귀결하였다.
Abstract
This paper investigates the causal mechanism of policy formation in the case of immigrant policy, especially, migrant worker's policy in Korea since 1990s. This paper defines the migrant worker policy as ‘paternalist’, that is, a policy that treats migrant workers as the object of caring that evades relationship based on rational contract or political equality. In order to analyze the formation of the paternalist migrant worker policy, this paper utilizes the theory of policy formation that employs the policy domain and the policy paradigm as main causal factors. Especially, this paper sees that the multiculturalist policy based on “the politics of recognition” is produced through racial/ethnic dynamics taking place in the interaction between the state and the racial/ethnic groups. By combining this perspective with the analysis of migrant worker policy formation in Korea, this paper concludes that the paternalist policy is made possible through the closed partnership between the state and the service organizations and the employment of “tolerance” paradigm as a policy guideline which emphasizes service programs such as language education, family, missionary work, and community support. This policy orientation excludes from the policy domain the migrant workers' groups and their logic of politics of recognition which emphasizes their collective identity and social rights as a minority group.
