본 연구는 중일관계의 주요 현안 중 하나인 전후보상문제 해결을 위해 새로운 접근법을 제시하고자 한다. 이를 위해 중일관계를 전후보상소송의 차원에서 검토하고, 이행기정의의 관점에서 분석을 시도하였다. 그동안 일본 법원에 전후보상소송을 제기해 온 중국의 강제노동 피해자들은 계속되는 패소로 성과를 얻지 못하자, 최근에는 중국내 법원에 소송을 제기하기 시작하였다. 이러한 중국의 대응 양상의 변화는 중국 정부와 학자들의 지지와 맞물려 일본 기업들에게서 보상의 움직임을 이끌어내고 있다. 이를통해 한국의 강제노동 피해자들에게 주는 함의를 찾고, 궁극적으로는 동북아시아 지역의 과거사 극복을 위한 대안을 모색하고자 한다.
Abstract
This study proposes a new approach to settle the issue of post-war compensation, one of the key pending subjects of Sino-Japanese relations. The study examines bilateral ties between China and Japan by looking at post-war compensation lawsuits, and introduces post-war compensation as a necessary condition to accomplish restorative justice. Such lawsuits have entered a new phase since frustrated victims began seeking redress through Chinese courts after repeatedly losing their cases in Japan. The process of seeking post-war compensation through the courts should not be viewed as a means of attaining retributive justice, but rather a stepping stone to achieving restorative justice.
