제도 보완성에 기초한 통일 독일의 지방행정체제 구축사례 연구

최근 한반도에 평화정착과 장기적으로 남북통합에 대한 기대가 높아지고 있다. 남북통합이 이루어진다면 그 과정에 북한 주민들에게 안전･주거･식량･전기･상하수도 등 필수적인 공공서비스의 제공이중요한 과제가 될 것이다. 이 연구는 그 대비의 일환으로 남북한 지방행정체제 통합의 기초 작업으로서제도 보완성 관점에서 이 문제를 다루어보았다. 이는 지방행정체제가 국가운영원리･정치･경제 등 다른 영역의 제도들과 상호 보완성을 가지면서 작동한다는 최근 제도 연구들의 주장에 기초한 것이다. 정책적 시사점을 얻기 위해 통일을 이룬지 28년째 접어들고 있는 독일 사례를 제도 보완성의 시각에서 분석하였다. 분석 결과 독일의 지방행정체제 통합은 분단기간 동안에 시행된 상호 교류와 문화적 친숙화라는 준비과정, 공식통합 이전 필요한 법령과 제도의 정비과정, 그리고 통합 후의 지방별 제도 보완성확립과정 등 3단계로 이루어졌음을 파악하였다. 이 결과는 남북한 지방행정체제 통합도 정치체제･경제등 다른 제도와의 보완성을 염두에 두고 단계적으로 시행해 나갈 필요가 있음을 시사하고 있다.
Abstract
Recently, with processing of North Korea's denuclearization, the expectation of Korean Peninsula Peace Regime and Reunification of two Koreas is getting higher than ever. With this circumstances, this study dealt with the Integration of the Local Administration System as a preparation of South-North Reunification, During the process of integration, North Korean people should be provided essential services like food, water, safety etc. and it is the Local Administration System that provide this services. So the Integration Plan of Local Administration System had better be prepared prior to Reunification. To acquire suggestions, this study analyzed Unified German Case which has been passed 27 years already since Reunification with the perspective of Institutional Complementarity (IC). Recent studies has shown that Local Administrative System as a institution has worked with the Government Operating Principles (federalism, democracy, rule of law, social state) and Political, Economical institutions as well with regard to the IC. The result of analyzing, we found out that the Unified German's Integration of the Local Administrative System has been achieved by step-by-step process to get ICs. Actually it consisted of 3 steps. First, it was preparation step happened during Germany's divided period. During this period, many cultural, material, personal things including tour, letters, TV watching have been exchanged and it enhanced mutual understanding and familiarization. Second, the period of formal integration(1989-1990.10), necessary laws and institutions was settled in the perspective of the IC. Lastly, after Reunification, Local Governments have developed their own progress reflected their unique environments. This result suggests that the Integration of South-North Local Administrative System has to be prepared by step-by-step process to keep IC with other institutions like Government Operating Principles and political, economical institutions.
