홉스는 철학의 체계성과 논변의 일관성을 누구보다 강조했고 또 이 때문에 심지어 그의 적대자들로부터까지 칭송받곤 했지만, 역설적이게도 그의 정치철학은 그 방법론과 내용의 해석과 평가에서 항상 격렬한 논쟁의 대상이었다. 그러나 그 많은 논란에도 불구하고 모든 홉스 연구자는 홉스가 근대 정치철학의 혁명적 창시자이고 현대를 사는 우리가 긍정적인 의미에서건 부정적인 의미에서건 간에 그리고 그 영향이 크건적건 간에 그의 후계자들이라는 사실에 동의한다. 그런데 홉스의 정치철학이 지닌 근본적인 혁신성 중 하나가 바로 그의 소유론에 있다는 사실은 흔히 간과되곤 한다. 본 논문은 이처럼 중요하면서도 아직 매우 미진하게 다루어져 온 홉스의 소유론을 주제로 한 연구의 일환이다. 이 연구는 매우 포괄적인 작업이 될 터인데, 그중에서 우선 본 논문은 그 첫 번째 작업으로 홉스의 소유(권) 개념을 상세하게 분석할 것이다. 이를 위해 먼저 ‘dominion’이라는 용어를 중심으로 홉스의 소유(권) 개념의 용법과 함의를 고찰할 것이다.(제2장) 다음으로 근대적 소유권 개념이 지닌 변별적 특징들인 법적 권리성, 사유성(私有性), 처분의 임의성, 배타성, 완전성이 홉스의 소유권 개념에서 어떻게 나타나는지를 분석할 것이다.(제3장) 그러고는 홉스가 소유권의 주체로 제시하는 ‘인격자 또는 인격체’는 어떤 의미와 범위를 갖는지(제4장) 그리고 소유권의 대상으로 제시되는 것은 구체적으로 무엇인지(제5장) 살펴볼 것이다.
Abstract
Although Hobbes emphasized the systematicity and coherence of his philosophy and was often praised for it, even by his enemies, his political philosophy has paradoxically always been the subject of intense debate in the interpretation and evaluation of its methodology and content. However, despite all the controversy, all Hobbes scholars agree that Hobbes was a revolutionary founder of modern political philosophy and that we in the modern world are his successors, whether in a positive or negative sense, and whether his influence is great or small. However, it is often overlooked that one of the fundamental innovations of Hobbes’s political philosophy is his theory of property. This paper is part of a study of this important and still very under-explored aspect of Hobbes’s theory of property. This study will be a very comprehensive work, but as a first step, this paper will analyze Hobbes’s concept of property in detail. It will first examine the usage and implications of Hobbes’s conception of property, focusing on the term “dominion.” (Chapter 2) Next, it will analyze how the distinctive characteristics of the modern conception of property - legal right, private ownership, arbitrariness of disposition, exclusivity, and perfection - appear in Hobbes’s conception of property. (Chapter 3) We will then examine the meaning and scope of the “person” that Hobbes presents as the subject of property (Chapter 4) and what specifically is presented as the object of property (Chapter 5).
