경찰개혁을 위한 시민신뢰에 관한 연구

초록

신뢰가 낮은 경찰을 신뢰할 수 있는 조직으로 만든다는 것은 경찰개혁의 핵심 과제이다. 처음부터 신뢰할 수 있는 경찰을 만든다는 것은 매우 어려운 일이다. 그러나 경찰의 존재이유가 시민을 보호하는 일이기에 시민의 신뢰는 반드시 필요한 것이라고 이야기 할 수 있다. 시민의 신뢰 없이는 경찰의 법집행, 위험방지, 질서유지와 같은 경찰활동을 제대로 할 수 없으며 결국 이는 시민을 위한 경찰개혁의 가장 기본적인 전제조건이 되는 것이다. 이 연구는 신뢰에 대한 본질적인 의미를 살펴보고 신뢰를 약화시키는 구조적 문제점에 대하여 알아보는 것이다. 경찰에 대한 불신은 크게 경찰의 권력적 작용, 경찰의 정치적 역사, 경찰관에 대한 면책성 마지막으로 시민을 의심하는 태도로 기인하게 된다. 이를 방지하고 신뢰를 구축하기 위하여 첫째, 공평하고 투명한 법집행을 행하여야 하고 둘째, 과도한 공권력을 제한하며 셋째, third parties를 활용하여 상호이해를 높이고 넷째, 시민의 불신을 이용하여 시민의 참여와 감시를 독려하고 다섯째, 지역사회만의 특수한 상황을 고려하여 시민의 신뢰를 구축하고 마지막으로 시민사회의 적극적인 역할을 통하여 경찰과의 관계를 재정립하는 방안을 제시하였다.

Abstract

Establishing trustworthy police forces is the key challenge for police reformers in low-trust settings. For many reasons, trustworthy police forces are difficult to maintain, and even harder to establish from scratch. They however remain important both to preserve where they exist and to establish where they are absent. Without them, the vulnerability of ordinary citizens to human rights abuses will be much greater. In their absence, the very idea of policing by consent will remain, at best, a phantasm. This literature therefore suggests that the process of ensuring trustworthy police. Reasons not to trust the police are, their structural location and historical functions, impunity and 'Reason to suspect’. The article concludes by pointing to some inherent limits or constraints upon trust-building, including the impact of the wider environment in which policing occurs, and the need to trust the tools we use for building trust.
