미국은 1960년대 이전까지 경찰의 공권력 남용, 전통적인 신뢰제고 전략의 실패 등으로 국민의 불신을 자초하고 있었다. 그러나 시민감시제도를 도입하여 경찰에 대한 민원처리에 시민을 참여하도록 함으로써 경찰부패의 통제, 신뢰도 제고와 민주적 정당성 확보라는 효과를 거두고 있다. 시민감시제도는 미국에서 경찰권의 행사를 통제하려는 시도에서 출발하였는데 경찰에 대한 민원의 독립적 심사, 정책검토와 제언, 민원조사의 감시, 경찰하위문화 개혁 및 지역사회 봉사의 기능을 수행한다. 시민감시제도는 미국에서의 긍정적인 역할과 성공적인 정착을 통해 영미법계 다른 국가에도 보편적인 것으로 채택되어 시행되고 있다. 우리나라 경찰이 처한 현재의 상황은 신뢰의 부족, 전통적․내부적 신뢰제고 전략의 실패 등 미국에 시민감시제도가 채택되기 전의 상황과 유사하다. 따라서 제도적․역사적 배경의 차이에도 불구하고 시민감시제도는 우리나라에서도 도입을 적극적으로 검토할 가치가 있다고 판단된다. 시민에 개방적이고 그들의 참여를 허용해 국민의 신뢰를 받는 경찰, 그리고 자긍심을 갖고 임무를 수행하는 경찰은 우리가 꿈꾸는 이상적 경찰이기 때문이다.
Abstract
Before 1960s, America was bringing distrust on itself due to the abuse of public power of the police, failure in the traditional strategy of improving reliability.However, since the introduction of the citizen oversight system by which American citizens can participate in civil application or appeal against the police, the country has accomplished the reform of the police system in controlling corrupt police, rebuilding trust and securing democratic justice. The system started in an attempt to control the exercise of police power and has played roles of independent judgment on the appeal filed against the police, proposal of policy review, monitoring of the appeal survey, reform of subcultures of the police and volunteering work for a community. Thanks to the positive roles and successful settlement of the system, it has been universally adopted by other countries governed by Anglo-American law. The current status facing Korean police is very similar to that of American police before the adoption: lack of reliability on the police, strategic failure of improving internal reliability. Accordingly, despite the difference in institutional and historical background, it is believed valuable to actively review the introduction of the system. Open to the citizens, trusted by the public through allowing their participation and proud of their own work, Korean police will be the ideal police we have dreamed of.
