청소년범죄의 폭증과 이에 대한 사회적 피해의 확산, 해당 청소년들에 대한 처리 등이 심각한 현안으로 대두되고 있다. 이에 소년경찰제도의 정립과 전문화와 관련한 내용들이 논란의 중심에 서고 있다. 본 논문은 우리나라 소년경찰제도의 문제점과 이러한 문제점을 유발하는 소년사법제도상의 문제점에 대해 논의하여 보고, 이를 개선하기 위한 방안을 제시하고자 하는데 목적이 있다. 특히 검사선의주의나 경찰 조직 내 여성청소년 부서의 모호한 조직구성, 전문 인력양성의 부재상황 등을 논의하고 이에 대한 개별적인 해결 및 개선방안을 제시하였다. 소년법의 심각한 독선적 조항이라 할 수 있는 검사선의주의의 문제점과 아울러 소년사건의 1차적 처리기관이 대부분 경찰로 되어 있는 외국의 내용을 기초로 하여 바람직한 한국 소년경찰의 자리 메김 방향을 제안하였다.
Abstract
The dramatic increasing number of juvenile crime and its harm the our society becomes major social problem in Korea. In order to solving this problem, the specializations of youth police function are argued by scholars and police executives. This study have several objectives such as improvements of police juvenile crime process, criminal and youth laws on juvenile crimes, inefficiency of youth police unit in each police stations. Some solutions and suggestions for improving effectiveness of youth police function will be useful to domestic juvenile crime, deviance, and delinquency. Exclusive authorities of public prosecutor get in the way of youth police and it prevent development of specialized youth police. Bettermost countries in the world have approved police discretionary power of youth police. We will have to follow this directions for reforming youth criminals.
