해운법 제24조 제4항은 대량화물 화주의 해운업 진출시 정책자문위원회의 자문을 거쳐 국토해양부가 등록 여부를 결정하도록 규정하고 있다. 현재의 대량화물 운송시장은 국내외 해운기업이 치열하게 경쟁하는 시장이다. 그러므로 대량화물 화주의 해운시장 진입이 경쟁을 증대시킬 것인지, 아니면 새로운 시장지배적 사업자의 출현 등으로 경제력 집중을 심화시키고, 수직결합에 따른 지배력 전이, 거래거절, 차별 등의 행위로 해운시장에서의 경쟁을 오히려 저해할지에 대해서는 경제적 분석이 필요한 사항이다. 논문의 분석 결과에 따르면 대량화주의 해운업 진출은 해운업 시장에서 경쟁을 촉진시키고, 운임 절감을 통한 수출경쟁력을 증대시키기 보다는 규모의 경제, 최소생존규모의 미달성으로 해운선사의 국제경쟁력 저하에 따른 시장퇴출, 신규진입기업의 경험부족 등으로 인한 추가비용이 발생할 가능성이 더 높다고 할 수 있다. 따라서 대량화물 화주의 시장진입 여부를 정책자문위원회의 자문을 거쳐 국토해양부가 최종적으로 결정하도록 한 규정은 해운산업의 특수성을 고려할 경우 필요성이 인정되는 규정이라 판단된다.
Abstract
According to the Article 24(4) of the Maritime Transport Act, the Ministry of Land, Transport and Maritime Affairs (MLTM) decides whether the entry of an owner of lot cargo into the maritime transport service market will be registered or not through a consultation of policy-advisory committee. The shipping service market of lot cargo is already competitive. Since it is not clear whether the entry of an owner of lot cargo into the maritime transport service market will fertilize competition further or not, an economic analysis needs. The results of this article say that the entry of an owner of lot cargo into the maritime transport service market does not fertilize competition further nor increase competitive power of exporting goods. It decreases scale economy of incumbents, and prevents incumbents from achieving minimum efficient scale or Stigler's minimum survival scale. As a result, the incumbents' possibility of exit from the maritime transport service market will be increased. Since the entry of an owner of lot cargo into the maritime transport service market is not clear as this article's results, and also considering special characteristics of the shipping industry, the Article 24(4) of the Maritime Transport Act is still necessary.
