절차적 정의 이론의 연구동향과 향후 과제에 대한 고찰

초록

절차적 정의 기반 경찰활동은 Tyler(1990)에 의해 소개된 이후, 최근까지 매우 활발하게 연구되고 있는 주제 중 하나이다. 해외에서는 ‘경찰활동의 절차적 공정성 → 경찰 정당성 제고 → 시민들의 법준수, 협력의사 제고’라는 초기 Tyler 모델에 대한 실증연구를 벗어나, 실험 및 준실험적 연구, 경찰관의 절차적 정의 실천 영향 요인에 관한 연구, 경찰관 대상 절차적 정의 교육프로그램의 효과 검증 등 다양한 주제로 확장되고 있다. 본 연구에서는 해외 절차적 정의 및 경찰 정당성 이론에 관한 최근 연구의 흐름을 조망하고, 이를 관련한 국내 연구의 동향을 분석하였으며, 이를 토대로 향후 연구방향에 대해 논의하였다. 총 36건의 국내 절차적 정의 관련 학술연구에 대한 분석결과, 국내에서는 비교적 최근에서야 절차적 정의 이론에 대한 실증연구가 시작되었으며, 이 중 대다수는 Tyler의 초기 모델을 적용, 검증하는데 머무르고 있다는 것을 확인하였다. 반면, 일부 연구들은 기존의 연구틀을 벗어나 자기정당성, 교육프로그램, 절차적 정의와 대응성의 관계 등으로 연구의 주제를 확장하려는 시도를 하고 있는 것으로 나타났다. 본 연구에서는 선행연구들을 이론적으로 고찰하고, 관련된 국내 연구경향 분석결과를 토대로 연구주제의 다양화, 설문조사 방식 외의 연구방법 다각화, 경찰관의 절차적 정의 실행의 영향요인에 대한 탐색적 연구, 절차적 정의 교육프로그램에 대한 연구 등의 후속 연구 방향을 제시하였다.

Abstract

The procedural justice-based policing introduced by Tyler (1990) is one of the most popular research topic of police science. Beyond testing Tyler model( ‘Procedural justice of policing → Police legitimacy → compliance and cooperation’), the global research trend is expanding to various directions such as experimental and quasi-experimental research, research on the factors influencing police officers' procedural justice practice. This study reviewed the flow of the recent research, and analyzed trends in domestic research related procedural justice and police legitimacy theory. As a result of analyzing 36 domestic studies published in KCI journal, it is found that empirical studies on procedural justice theory have only begun relatively recently in Korea, and the majority of them remain in testing Tyler's theoretical model by using Korean citizen sample. And some studies have been attempting to expand the research topics to the finding relationships between various variables such as self-legitimacy, police procedural justice training program, responsiveness. Finally, this study theoretically reviewed previous studies and suggested future directions for researchers such as expansion of research topics, development of research methods to overcome the limitation of cross-sectional survey, investigating and testing on the factors influencing police officers' procedural justice implementation, and enhancing on the procedural justice education programs research.
