YAR상 구조보수조항의 기본적 문제점에 관한 연구

본 연구에서는 1974년-2004년 YAR의 구조보수와 환경손해에 대한 기본적 문제점을 분석하며, 로이즈구조계약표준서식(LOF) 또는 그것과 유사한 구조계약서식상 구조보수에 대한 공동해손상의 위상과 관련된 문제점을 영국법 중심으로 분석한다. 구조보수에 대한 YAR상의 위상은 제3의 시대를 통한 기본적 문제이었다. 실무자는 1974년 YAR(1990년 개정), 1994년·2004년 YAR을 모두 현행규칙으로 보고 있으며, 또한 LOF형 구조보수를 공동해손으로 인정하는 규정과 인정하지 않는 규정이 병존하는 통일되지 않은 구조가 남아 있다. 더욱이 2004년 YAR은 선주단체로부터 지지가 없는 상태에서 채택된 유일한 YAR이므로 향후 채택될 전망이 없다고 볼 경우 불통일의 구조는 쉽게 해소되지 않을 것으로 보인다. 또한 제3의 시대에는 공동해손행위의 직접적 결과로서 또는 그것과 관련하여 발생하는 유류오염손해, 더욱이 환경손해라는 새로운 문제가 해난구조계약과 관련된 형태로 YAR에 포함되게 되었다.
Abstract
The purpose of this work aims to analyse the fundamental problems on salvage remuneration and environmental damage under the 1974-2004 YAR. The YAR 1974, as amended 1990, YAR 1994 and YAR 2004 are considered as current rules to practitioners. Under LOF salvage remuneration type, it remains that is not a unified composition owing to coexisting of the rule is recognized as general average and do not recognize this. Moreover, because the YAR 2004 is only YAR that is adopted in the absence of support from the shipowner groups, it seems to no future prospects to be adopted. Accordingly, a structure of disunity seems to be not easy to resolve. In addition, in the third period, as a direct result of the general average act, or it occurs with respect to oil pollution damage. Furthermore, environmental damage has appeared in YAR as a new problem related to the form of salvage contract.
