스웨덴 지방자치단체의 복지 사무에 관한 연구

본 연구에서는 스웨덴에서 지방자치단체의 복지사무에 대한 법적 제도적 장치를 살펴보고 한국의 복지 분권에 시사점을 도출하고자 하였다. 연구 문제는 다음과 같다. 첫째, 스웨덴의 지방자치제도의 성격은 어떠한가? 둘째, 스웨덴의 복지 분권의 성격은 어떠한가? 셋째, 스웨덴의 재정분권의 성격은 어떠한가? 분석 기준은 지방분권의 지표인 복지 사무 분권과 재정분권으로 스웨덴의 지방자치제도를 분석하였다. 분석 결과 스웨덴의 지방자치제도의 특징은 유럽 지방자치헌장(European Charter of Local Self-Government)에 근거한 보충성(Subsidiaries)의 원칙, 스웨덴 헌법에 근거한 비례성(proportionality)의 원칙, 헌법과 지방정부 법에 근거한 민주주의 요소로 나타났다. 이는 헌법과 지방정부에 의거하여 복지 사무가 중앙, 광역시, 지방자치단체 차원에서 복지 사무 분담이 어느 정도 뚜렷하게 이루어졌다. 광역시의 주요 사무는 공공보건의료로 스웨덴 보건의료법에 의거하여 광역시의 책임으로 명시되어 있었다. 지방자치단체의 주요 업무는 사회서비스로 스웨덴 사회서비스 법에 의거하여 지방자치단체의 책임과 사회복지위원회의 전문 인력을 구성하고 있었다. 재정분권은 70% 정도 지방정부의 독립적인 과세권과 일부는 중앙 보조금으로 충당되고 있었다. 결론적으로 스웨덴은 보충성, 비례성, 민주성의 원칙에 따라 복지 사무분권과 재정분권이 제도화되어 있으며, 이는 스웨덴의 근본가치인 민주성과 평등성을 높이고 있었으며, 업무의 효율성과 효과성이 높은 것으로 나타났다. 한국에서도 지방자치제도의 명확한 원칙을 설정하고 지방정부의 자치권을 강화시켜야 한다. 그래야만 지역 특성에 맞는 사회복지를 개발하고 주민들의 복지의 만족도를 높일 수 있으며, 재정자립도를 높여 지방정부의 독립성을 강화시킬 수 있기 때문이다.
Abstract
This study aims to draw implications for Korea's welfare decentralization system by looking at legal and institutional mechanisms for welfare affairs in Sweden, a leading country in northern Europe. First of all, what is the nature of the local autonomy system in Sweden? Second, what is the nature of the welfare decentralization in Sweden? Third, what is the nature of financial decentralization in Sweden? The analysis criteria are welfare office decentralization and financial decentralization, a measure of decentralization, and the local autonomy system in Sweden were analyzed. The analysis showed that the characteristics of Sweden's local autonomy system were the principle of subsidization based on the European Charter of Local Self-Government, the principle of proportionality based on the Swedish Constitution, and democratic elements based on the Constitution and local government laws. Under the Constitution and the Local Government Act, the sharing of welfare services was clearly achieved at the central, metropolitan and provincial levels. The main office of the metropolitan city was designated as a responsibility of the County Council in accordance with the Swedish Health and Medical Act as a public health care fee. The main tasks of local governments were social services, which constituted the responsibility of local governments and professional personnel of the Social Welfare Commission in accordance with the Swedish Social Services Act. The fiscal decentralization was covered by 70 percent of the local government's independent taxation rights and some by central subsidies.
