본 연구는 스웨덴 지방자치제도와 복지 사무에 관한 연구이다. 연구 목적은 스웨덴의 성숙한 지방자치제도를 정착시킨 형성배경과 그 특징을 분석하고, 지방분권의 입헌적 관점을 탐색해보고, 스웨덴의 분권화된 지방 복지 사무를 살펴보는 것이다. 스웨덴의 지방 자치제도는 고대 자연 발생적으로 꽤 오랜 전통을 가지고 있었으며, 복지국가 건설 전에는 지방행정과 복지사무가 교회의 역할이 컸다. 이후 지방행정법과 지방 자치법은 지방분권을 강화시켜주었으며, 복지국가 건설이후 코뮨의 행정 개편, 민영화, 유럽연합의 가입은 현재의 지방자치제도의 모습을 갖추게 되었다. 스웨덴 헌법에서 정부조직법 조항들은 대의제와 지방자치제를 명시하고 있으며, 지방정부법은 구체적으로 란스팅과 코뮨의 관계, 중앙정부간의 관계, 업무 등을 규정하고 있다. 스웨덴의 복지 사무는 중앙과 지방정부인 란스팅과 코뮨으로 분권화되어 있다. 중앙정부는 사회보험이나 수당 등 전국적 공공재를 담당하며, 란스팅은 준 공공재로 의료나 치과, 재활 등 복지 사무를 담당하고 있다. 코뮨은 지역주민의 욕구를 고려한 사회돌봄 서비스와 교육을 주요 업무로 담당하고 있다. 중요한 점은 이런 분권화는 성숙한 민주주의를 기반으로 한 효율적이고 효과적인 업무처리가 가능하다는 것이다.
Abstract
This study is about Swedish local government and welfare affairs. The purpose of the study is to analyze the formation background and its features that have settled the mature local autonomy system, explore the constitutional view of the decentralization, and look at the decentralized local welfare office of Sweden. Sweden's local autonomy system had a fairly long tradition of occurring in ancient nature, and the role of the church was large before the establishment of a welfare state. Since then, the Local Administrative Act and the Local Autonomy Act have strengthened the decentralization of the local government, and the administrative reorganization, privatization, and accession of the European Union since the construction of the welfare state has taken shape of the current local autonomy system. In the Swedish Constitution, the provisions of the Instrument Act specify representative and local governments, and the Local Government Act specifically stipulates the relationship between Lanxing and Kocheng, the relationship between the central governments, and the work. Sweden's welfare offices are divided into central and local governments, Lansting and Commune. The central government is in charge of nationwide public goods such as social insurance and allowances, while Lansting is in charge of welfare affairs such as medical care, dentistry and rehabilitation as quasi-public goods. Commune is responsible for social care services and education, which take into account the needs of local residents. What's important is that such decentralization enables efficient and effective work-processing based on mature democracy.
