중앙정부 주도의 의무적인 국고보조사업이 확대되면서 지방자치단체의 자체사업 비중과 기능이 계속 축소되고 있다. 이러한 상황에서 효율적이고 책임성 있는 정부간 재정관계를 정립하기 위한 첫 단계로서 중앙정부의 재정적 의사결정이 지방재정과정을 왜곡시키지 않도록 하는 최소한의 법적 기반이 마련될 필요가 있다. 본 논문은 그 법적 기반의 구체적인 형태로서 안정적인 지방재정사업 운영을 위하여 의무지출 국고보조사업에 대한 최소한의 준칙을 제안하면서 그 근거와 구조 그리고 입법화 방향을 논의한다.
Abstract
There has been an on-going argument for restructuring specific-purpose grant system in order to boost production efficiency of the local public goods and services. This paper is aimed to propose a legal guideline – a fiscal rule against unfunded mandates – for a local government to enhance its autonomy and accountability. Particularly, we argue for the necessity and reason for the legal safeguard against the central government’s control of local finance for its own interest on the cost of their local governments. Accordingly we shed light on its properties and elements which are supposed to be successful and effective.
