의약품 허가-특허 연계제도에 도입에 따른 시사점: KORUS FTA를 중심으로

2010년 12월 한-미 FTA 재협상이 타결되면서 의약품 분야의 ‘허가-특허 연계’ 제도에 대한 관심이 재조명되고 있다. 허가-특허연계조항이란 의약품 특허권자의 권리를 보호하기 위해 특허기간이 존속하는 동안 허가와 특허를 연계해 복제약품(또는 제네릭(generic) 의약품) 시판을 금지하는 제도이다. 특허기간 도중 복제약 시판허가를 신청한 사람은 그 신원을 특허권자에게 통보하고 특허권자의 동의 없이 제네릭 제품의 판매가 허가 되지 않도록 하는 조항이라고 요약할 수 있다. 이 제도는 WTO TRIPs 규정에 포함되지 않은 WTO TRIPs plus 규정으로 미국에서 Hatch-Waxman법의 일환으로 처음 도입되었고, 캐나다는 이후 NAFTA 가입으로 인해 본 제도를 도입하였다. 본 논문은 미국과 캐나다의 제도 시행 과정 및 제도 운영상의 문제점을 분석하였다. 아울러 허가-특허 연계제도와 관련한 KORUS FTA 협정문의 분석을 통해 미국과 캐나다의 제도 운영상의 문제점과 연관시켜 동 제도 도입에 따른 발생 가능한 문제점들을 분석하였다. 무엇보다도 제네릭 의약품 생산에 주력하는 구조를 가지고 있는 국내 의약품 업계에 제네릭 의약품의 시장 진입 지연으로 인한 매출 손실이 불가피하고, 특허 침해 등의 소송 발생률이 증가할 것으로 예상되어 진다. 이에 대해 국내 제약 산업의 구조 개편, 특허 물질에 대한 데이터 관리 체계 구축, 제도 시행으로 인한 문제점에 대비할 수 있는 철저한 법 개정 및 규정의 제정이 필요하다.
Abstract
Since the KORUS FTA re-negotiation was concluded on December 2010, the introduction of Drug Approval-Patent Linkage system has become the centre of public interest. The approval-patent linkage system was originally designed in order to protect patents' right. The patent owner shall be notified of the identity of any other person who requests marketing approval to entre the market during the term of patent. Consequently, this provision indicates that any pharmaceutical company which makes generics cannot have the permission of marketing its generics without approval of patent owner. WTO TRIPs does not include this provision, which means it is WTO TRIPs plus. The approval-patent linkage system was firstly introduced in the United States as a part of 'Hatch-Waxman Act', and Canada also adopted this system when joining NAFTA. This article analyses the process in the operation of this system and problems caused after the introduction of this system in the United States and Canada. In addition, any possible problems beought about after the entry into force of the KORUS FTA and the introduction of the approval-patent linkage system are discussed based upon the analysis of related provisions in the KORUS FTA to this system in chapter IV. Most of all, the structure of domestic pharmaceutical industry which mainly produce generics eventually leads to the loss on sale because of the delay of marketing approval. The introduction of the approval-patent linkage system is also sure to increase legal exposure to domestic generic producers. Therefore, this article suggests that the reform of domestic pharmaceutical industry, the establishment of data management system of the patent of material and an exhaustive and detailed enactment and amendment of the relevant law in order to effectively respond to any possible problems caused by the introduction of the approval-patent linkage system.
