Abstract

The article examines the KORUS FTA provisions relating to intellectual property rights for medicines, focusing on what was agreed distinctively from normal arrangements, what is the appropriate assessment on those provisions, and how they will be implemented in domestic laws. The KORUS FTA TRIPS-plus provisions for medicines, such as patent linkage and data exclusivity, are new to Korea’s domestic legal system, which brings on various criticisms and reservations from domestic pharmaceutical companies and experts. However, a falsely-based allegation that domestic industry would be crippled by the KORUS FTA is also inappropriate since it would only result in unnecessary political costs in the course of FTA implementation. At the current stage, discussion must be centered on the objective assessment of the agreed text rather than adhering to the dichotomy and confrontation. This study is summarized as follows. Firstly, impacts on the current domestic patent system by the KORUS FTA TRIPS-plus provisions for medicines would not be significant as pharmaceutical industry had claimed. For instance, data exclusivity obligation has already been incorporated when implementing the TRIPS Agreement in 1995. The provision of patent compensation for unreasonable delay is not inconsistent with the current patent law. Secondly, in the case of patent linkage, although it might be an additional burden to domestic generic medicine manufacturers, it should not be treated as an unfair concession which would pose serious damages on domestic pharmaceutical industry. The scope of the provision is limited to the case where a generic drug company seeks a marketing approval relying on already submitted test materials by a patent owner company. In addition, the agreement itself permits substantial flexibility for implementation, which allows the party to choose appropriate measures in order to minimize any possible negative effects in introducing this new system.
