특별부담금의 헌법적 정당화요건에 대한 소고 - 헌법재판소의 결정을 중심으로 -

오늘날 특별부담금이 등장하고 있는데, 국민의 기본권을 제한한다는 점에서 그 헌법적 정당성을 획득하는 것이 필요하다. 특별부담금에 대한 헌법재판소 결정에는 헌법적 정당화 요건이 등장하고 있다. 그런데, 그 헌법적 정당화요건의 적용이 일관되지 않고 불명확한 문제점이 드러나고 있다. 필자는 이런 문제점에 대하여 그 대안을 제시하고자 한다. 특별부담금을 4가지로 나누고 주된 목적이 무엇인가에 따라, 먼저 순수하게 재정조달을 목적으로 하는 경우, 정책실현의 목적은 부차적이고 재정조달을 주된 목적으로 하는 경우에는 엄격한 헌법적 정당화요건을 적용하고, 그 다음으로는 순수하게 정책실현을 목적으로 하는 경우, 재정조달 목적은 부차적이고 정책실현을 주된 목적으로 하는 경우에는 완화된 헌법적 정당화요건을 적용하는 것이 타당하다고 보고 있다. 이러한 방법이 헌법재판소가 특별부담금에 대하여 명확한 표현에 따른 결정을 내리는데 도움이 되고자 한다.
Abstract
Special assessments are emerging today. It is necessary to acquire its constitutional legitimacy in that it limits the fundamental rights of the people. In Constitutional Court decision of special assessments, constitutional justification requirements have emerged. But application of constitutional justification requirements is not consistent and not clear. For this problem, I propose an alternative. Depending on what is the main purpose, special assessments is divided into four. A case of the purpose of purely financing, a case of the purpose of policy realization being secondary and the purpose of financing being main, are applied to strict constitutional justification requirements. A case of the purpose of purely policy realization, a case of the purpose of financing being secondary and the purpose of policy realization being main, are applied to relaxed constitutional justification requirements. In Constitutional Court decision of special assessments, I expect the Constitutional Court to take a decision in accordance with the clear expression.
