지방분권개혁의 제도변화에 관한 연구

초록

대한민국 제헌 「헌법」은 대한민국의 지방자치를 도입하였으나, 대내외적인 불안정적인 요소로 미뤄지다 전쟁 기간 중에 지방의회의원 선거가 실시되면서 지방자치가 운영되는 새로운 경로가 시작되었다. 3회에 걸친 지방의회의원 선거 기간은 10년에 미치지 못하며 지방자치단체장은 임명제로 운영되었으나 지방분권의 역사적 시발점을 이루었다는 데 의미가 있다. 지방분권은 1961년 5･16 사태로 약 30년간의 중단기를 겪게 되었고, 1987년 민주화 운동을 통한 대통령 직선제에 대한 요구는 노태우 후보의 6.29선언과 제9차 「헌법」개정으로 이어지면서 지방분권에 대한 부활로 이어진다. 1991년 제4차 지방의회의원선거를 계기로 중앙정부는 지방사무 조사 및 사무배분에 대한 업무 추진을 위한 기관을 설립하고 진행하게 된다. 총무처 산하 지방이양합동심의회는 비법정 기구로 획기적인 개혁 성과를 나타내지는 못하였으나 기본적인 지방사무 발굴･조사 업무를 수행하였다. 이 제도의 문제점을 보완하고자 김대중 행정부에서는 특별법 제정과 이에 근거한 위원회를 조직하고 확장된 업무를 수행하게 된다. 노무현 행정부에서도 제도가 유지되면서 지방분권 개혁 사무는 더욱 확장되면서 현재까지 이르게 된다. 오늘날의 지방분권은 신중앙집권화 이후 신분권화시대로 접어들면서 주민자치, 국토균형발전, 지역의 특수성 강화 등으로 나타난다는 특성이 있는데, 우리나라도 그 흐름을 같이 할 뿐만 아니라 특히 소위 진보 정권에서 지방분권의 가치지향을 나타낸다. 그러나 정권교체 이후에도 지방분권 개혁 제도는 사라지지 않고 지속되어 왔다. 중앙정부의 지방분권 개혁 제도는 1991년 재진입 이후 역사적 제도주의 관점에서의 경로의존적인 성격을 나타낸다. 지방분권 재진입기의 경로의존 유형은 동일한 정책이 지속적으로 유지 또는 재생산･반복 생산되는 것으로 기존 제도의 유지나 재생산은 주어진 패턴이 계속되는 즉, 잠금(lock-in)기능을 통해 기존 정책이 새로운 경로를 선택하거나 기존의 제도를 폐지･이탈하는 것을 어렵게 만드는 수확체증으로 설명된다(Mahoney, 2000: 515). 경로지속의 원인으로 먼저 정책이념의 영향, 정당성, 학습 효과 등을 들 수 있다.

Abstract

The constitutional Constitution of the Republic of Korea introduced the local autonomy of the Republic of Korea. Postponed due to internal and external instability factors During the war, local council elections were held, and a new route for local autonomy began. The three-time local council election period was less than 10 years, and the heads of local governments were operated by appointment system. It is meaningful in that it achieved the historical starting point of decentralization. Decentralization was stopped about 30 years due to the May 16 crisis in 1961. The demand for direct presidential election through the democratic movement in 1987 led to the revival of decentralization as Candidate Roh Tae-Woo’s 6.29 Declaration and the 9th revision of the Constitution led to the revival of decentralization. With the 4th local council election in 1991 as an opportunity, the central government established an institution to promote local affairs investigations and office distribution. As a non-statutory body, the Joint Regional Migration Council under the Ministry of Internal Affairs and Communications did not achieve epoch-making reform results. Basic local affairs discovery･investigation was carried out. To supplement the problems of this system, the Kim Dae-jung government enacted a special law, organized a committee based on it, and carried out expanded work. As the system was maintained under the Roh Moo-Hyun administration, the work of decentralization reform expanded further and reached the present. Today’s decentralization has the characteristics of appearing as residents’ autonomy, balanced national land development, and strengthening of regional specialties. Korea not only follows the trend, but also shows the value orientation of decentralization, especially in the so-called progressive government. However, even after the change of government, the decentralization reform system did not disappear and continued. After re-entry in 1991, the central government's decentralization reform system has shown path-dependent characteristics from the point of view of historical institutionalism. The path-dependent type of the decentralization reentry period is that the same policy is continuously maintained or reproduced･repeated production. The maintenance or reproduction of existing institutions is described as increasing returns that make it difficult for existing policies to choose a new path or to abolish ･ departure from existing institutions through the function of locking in a given pattern (Mahoney, 2000: 515). As the causes of path continuity, the influence of policy ideology, legitimacy, and learning effect can be cited.
