캐나다의 지역사회 교정처우에 관한 연구

초록

이 연구는 캐나다의 지역사회 교정처우의 특징에 대하여 살펴보았으며, 다음과 같은 결론 및 정책적 시사점을 찾을 수 있다. 첫째, 1992년 11월에 범죄자처우 등의 법들을 교정 및 조건부 석방법으로 전면개정하여 범죄자에 대한 체계적인 관리를 가능케 하였다. 둘째, 교정처우조직의 일원화를 도모하여 구금처우 및 지역사회처우 등을 모두 교정청이 관장토록 하였다. 셋째, 범죄자 처우의 체계화이다. 신입 구금형 수형자는 반드시 신입수용자센터에 90일 동안 입소하여 개인별 교정처우계획을 부여받도록 하였다. 넷째, 고위험자를 사법적평가대상자, 장기범죄자, 평화유지대상자 등으로 분류하여 처우의 집중화 및 개별화 정책을 취하고 있다. 다섯째, 2014년부터 정신장애수용자에 대한 별도의 교정처우계획을 운용하고 있다. 여섯째, 시설 수용자의 사회내처우는 반드시 가석방위원회의 가석방 또는 석방의 심사를 거치도록 하였다. 일곱째, 보호관찰 대상자의 재범 감소 등 범죄위험 지표가 낮아졌다. 여덟째, 자원봉사조직펀드를 조성하여 자원봉사자들을 지원하고 있다. 아홉째, 전통적 문화를 고려한 원주민 범죄자 지역사회 교정처우를 실시하고 있다. 캐나다의 지역사회 교정처우는 한국의 시설내외 처우 및 법령, 교정공무원 등의 이원화, 소년범 및 성인범에 대한 가석방위원회의 분리 등의 문제점을 해결하는데 정책적 역할 모델이 될 것이다.

Abstract

This study is to find the features and the lessons of the Canadian community correction treatment. First, Canada has instituted Corrections and Conditional Release Act in November 1992 integrates the legislation on calibration, parole, and community correction treatment. Second, Canada has been a unifying observation calibration and protect the organization. Canada Service of Corrections has charge of all detention treatment and community treatment of offenders. This helps the consistency of offender treatment. Third, Canadian offenders imprisoned the Federal Regional Reception Centre during 90 days for their correction planning. it is systematically performed facilities treatment and parole, and community treatment for offenders. Fourth, Canada has manage to classified high-risk offender such as dangerous offender, long-term offender and judicial restraint orders. Fifth, Canada has introduced a Mental Health Action Plan in 2014 for the systematic correctional treatment of mental disorders offenders. Sixth, the parole review process is start only offenders have proper qualifications with the requirements of the Corrections and Conditional Release Act. Parole Board must have decide to parole approved or rejected independently. Seventh, recently there are the reduction of recidivism and criminal violations of probation offender in canada. It shows that the community correction system in Canada is well settled successfully. Eighth, Canada has created a fund to support volunteers, and is actively leveraging their expertise. Ninth, Canada is a caring community correction treatment of the cultural characteristics with respect to Aboriginal offenders. Such Canadian communities corrective treatment will be a great role model to resolve the conflicts between probationary issues laws and organizations.
