혐오범죄의 법정책

초록

전세계적으로 혐오범죄에 대한 관심이 높아지고 있다. 특히 코로나19 이후 혐오범죄가 늘어나고 있다. 국내에서도 혐오범죄가 이미 발생하고 있다는 보고가 있으며, 2010년대부터는 혐오와 차별에 대한 관심이 높아졌고, 혐오범죄에 대한 연구도상당히 축적된 상태다. 하지만 세계 각국이 혐오범죄법을 제정하여 혐오범죄에 적극 대응하고 있지만, 한국에는 혐오범죄에 대한 법적, 정책적 기반이 전무한 상태다. 이러한 상황에서 이 논문은 혐오범죄에 대한 법정책적 대응을 모색해 보고자 한다. 먼저 혐오범죄의 개념을 정리해 보고, 유사 개념과 구분해 보았다. 그리고 혐오범죄의 국내외 현황을 살펴보았다. 혐오범죄는 새로운 범죄유형이라기보다는 기존의 범죄에 편견이라는 동기가 추가된 것이기 때문에, 혐오범죄법을 만들어 대응할 필요가 있는지 살펴보는 것이 중요하다. 이에 혐오범죄의 해악을 개인, 개인이 속한 집단, 헌법적 가치로 나눠서 살펴보고, 피해자 보호, 범죄 예방, 메시지 대응 등을 위해 혐오범죄 방지를 위한 법정책이 필요함을 설명했다. 혐오범죄에 대한 법적 대응에는 가중처벌 모델과 양형 가중 모델이 있음을 참조하여, 한국에서 실행 가능한 법정책으로는 처벌 강화, 양형 강화, 피해자 보호 등 기타 조치들, 통계 관리 등 정책적 조치등을 제시해 보았다. 마지막으로 혐오범죄 대응 입법으로, 혐오범죄 가중처벌 조항신설, 양형기준 개정, 혐오범죄방지기본법 제정 등을 제시해 보았다. 결론적으로, 혐오범죄방지기본법 제정을 가장 이상적인 방안으로 제시했으며, 혐오범죄의 가시화, 피해자 보호와 지원, 통계 구축, 관계 기관과의 협력 등의 관련 대책이 함께 마련되어야 함을 강조했다. 또한 혐오범죄와 같은 이유에서 발생하는 혐오표현, 차별 등에 대한 종합적인 대책이 마련되어야 한다는 점도 지적했다.

Abstract

Hate crimes are receiving more and more attention around the world. Especially after COVID-19, hate crimes are on the rise. There are reports of hate crimes already occurring in Korea and since the 2010s, there has been a growing interest in hate and discrimination, and a substantial body of research on hate crimes. However, while countries around the world are actively responding to hate crimes by enacting hate crime laws, there is no legal or policy foundation for hate crimes in Korea. Under these circumstances, this paper aims to explore the legal and policy responses to hate crimes. I first summarize the concept of hate crime, distinguish it from similar concepts, and examine the current status of hate crime in Korea and abroad. Since hate crime is not a new type of crime, but rather a prejudicial motive added to an existing crime, it is important to examine whether it is necessary to respond by enacting a hate crime law. I examined the harms of hate crimes to individuals, groups, and constitutional values, and explained that legal responses to hate crimes are needed to protect victims, prevent crimes, and counter messages. Referring to the legal responses to hate crimes as the penalty enhancement model and the sentence aggravation model, I presented the legal policies that can be implemented in Korea, including enhanced punishment, enhanced sentence, other measures such as victim protection, and policy measures such as statistical management. Finally, in terms of legislation to respond to hate crimes, I proposed the establishment of aggravated punishment for hate crimes, the revision of sentencing standards, and the enactment of the Hate Crimes Prevention Act. In conclusion, I stressed that the visibility of hate crimes, protection and support for victims, statistics and cooperation with related organizations should be systematically prepared, and suggested that ideally special laws such as the Hate Crimes Prevention Act should be enacted. It was also pointed out that comprehensive measures should be taken against hateful speech and discrimination based on the same grounds as hate crimes.
