증오범죄에 대한 형사 정책적 대응- 주요쟁점 및 선결과제 -

초록

증오범죄는 피해자 개인에게 보다 심각한 신체적, 정신적 피해를 가져올 뿐만 아니라, 그 개인이 속한 집단 및 사회전체에 미치는 파장이 크다는 점에서 그 심각성이 인정되며, 이로 인하여 외국의 많은 나라에서 특별한 유형의 범죄로 다루고 있다. 한국 또한 외국인의 증가, 집단 간 혐오의 증가 등으로 인하여 증오범죄로부터 자유롭지 않지만, 이에 대한 형사 정책적 대응은 전무하다. 증오범죄에 대한 대응책 마련 시 주요쟁점으로 증오범죄에 대한 가중 처벌의 필요성, 동기에 대한 처벌의 가능성, 증오표현 처벌의 위헌성, 보호집단의 범위 등을 논의하였다. 이와 같은 쟁점들이 논의되기 위한 선결과제로서 증오범죄 통계수집의 필요성을 제시하였으며, 이는 증오범죄 피해자에 대한 맞춤형 지원을 제공하기 위해서도 유용할 것이다.

Abstract

Specific criminal justice responses to hate crimes are often justified by its seriousness of consequences that include emotional trauma of the victim and increased fear among members of the victim group and the society as a whole. South Korea is also not free from hate crimes because of the increase of foreigners and defectors from North Korea, and the increase of conflicts between groups. Nevertheless, there are virtually no criminal justice countermeasures to hate crimes in South Korea. To address hate crimes in South Korea, I discuss four key issues including whether severe punishment for hate crimes is necessary, whether punishing thought is proper, whether punishing hate speech is unconstitutional, and which groups should be protected. Before addressing these issues, the top priority is to collect hate crime statistics. Collecting hate crime statistics would also be helpful to provide hate crime victims with customized support.
