법제 개혁과 국제협력모델 : 북한에의 적용과 남북협력

초록

이 논문은 북한의 경제체제전환을 지원하기 위한 법제도적 측면의 국제협력 모델을 제시하고, 이를 달성하기 위한 북한의 과제와 남북협력 방안을 모색하는 데 목적이 있다. 대부분의 체제전환 국가들의 사례에서 발견되듯이 보다 순조로운 시장경제로의 이행은 법제 개혁의 뒷받침 없이는 불가능했다. 이는 북한도 예외가 될 수 없을 것이다. 더구나 북한의 비핵화 노력을 계기로 북미, 북일관계 등이 진전되어 양자 혹은 다자간 기구의 북한에 대한 본격적인 개발지원이 시작될 경우 이를 수용하고 원조효과를 극대화하기 위해서는 북한 법제도를 국제적 수준으로 재정비하는 것은 시급한 과제이다. 이 글에서는 체제전환국 혹은 이행국가에 대한 법제 개혁차원의 일반화된 국제협력 모델을 검토하고, 이를 북한에 적용할 경우 직면할 수 있는 한계점 등을 보여준 뒤, 북한이 수용가능한 새로운 국제협력 모델을 제시하였다. 이 모델은 중장기적 접근과 사례분석을 통한 북한의 실질적 법제 수요 추정을 근거로 접근한 것이다. 이 모델의 실현성을 높이기 위한 북한의 과제와 남북한의 협력방안 제시를 통해 논문의 실용성을 높혔다.

Abstract

This dissertation presents a model for international cooperation in terms of legal reforms that facilitate the structural transformation of North Korean economy, and explores the challenges that North Korea faces in order to achieve the transformation. The dissertation also proposes future schemes for inter-Korean cooperation. Observations of the experiences of other transition economies reveal a principle that a smooth transition to a market economy requires fundamental legal reforms. The principle applies equally to North Korea. As North Korea’s effort in the denuclearization process has notably amended the U.S.-North Korea relationship, future prospects for bilateral, multilateral and institutional development assistance aimed at North Korea are on the rise. Therefore, laws regarding North Korea need to be remobilized to enhance North Korea’s management capacity and to maximize the impact of these assistance. The dissertation first examines the general model for international cooperation for reforming legal structures regarding the countries that have undergone, or are in the process of, transition to market economy. Following the examination, limits and challenges the model may face when applied to the North Korean situation will be discussed. Lastly, a new model for international cooperation that may be successfully embraced in the case of North Korea will be introduced. The new model approaches the structural transition of the North Korean economy based on the North Koera’s demands and case study analysis. The dissertation further indicates the challenges North Korea faces in order to facilitate the implementation of the new model and proposes future strategy for inter-Korean cooperation.
