Abstract
The purpose of this study was to examine the methods that the United States, Japan, Germany and Sweden have each adopted to offer support-in the form of bilateral international cooperation-to help transitional countries achieve legal reform. This study also aimed to assess the possibilities of applying the examples of the aforementioned countries to the North Korean legal system. The US was found to excel in all aspects, including the scale and details of support and the scope of support programs. But the country’s motive of offering such support is to propagate the American-style democracy and to open access to American exporters so that they can explore new market possibilities, rather than to help its recipient countries achieve a smooth transition. On the other hand, Japan’s support programs were found to be government-led, systematic and comprehensive, with strengths like field-centered and receptivity-oriented approaches and partnership-based operations. But the country’s main targets are limited to Asian countries which tend to guard against Japanese support due to their painful experience with Imperial Japan in the past. Germany was viewed as the most favored country by the majority of recipient countries. As for Swedish cooperation, recipients were mostly its neighboring countries and prospective EU member or applying nations, except for Vietnam. The first step that North Korea should be taking in embracing the support of each of the aforementioned countries would be to restructure its laws related to economy and finance as well as to attracting foreign investment. Considering the realities of the current international politics, the most likely countries from which North Korea receives international cooperation to complete its legal reformation will be European countries, such as Germany, with which the North has formed diplomatic relations.
