근대 사법제도 성립사 비교연구: 중국에 있어서 ‘법원조직’ 법제의 초기 형성

본 논문에서는 청말의 ‘豫備立憲’ 시기에 추진된 사법개혁 방안 중에서 특히 법원조직 법제의 근대화 과정을 추적분석하였다. 우선, 청말 법원조직 법제 개혁의 맹아적 형태를 살펴본 후, 1906년의 大理院審判編制法, 1907년의 天津府屬試辦審判廳章程과 各級審判廳試辦章程, 1909년(음)의 法院編制法 등에 대하여 면밀히 검토하였다. 당시의 법원조직 법제는 주로 메이지유신 이후 일본의 법제를 모방한 것이었지만, 중국의 특수상황을 고려한 변형이 부가되어 있다. 大理院審判編制法의 경우 ‘4급3심제’의 법원체제는 일본의 그것을 모방하였지만, 각급 법원의 관할은 중국의 전통적 체제를 유지하고 있다. 天津府屬試辦審判廳章程과 各級審判廳試辦章程의 경우, 일정지역을 선택하여 새로운 사법제도의 ‘실험실’로 활용하는 개혁방식을 채택한 점이 특징적이다. 法院編制法에서도 각급 법원에 ‘分院分廳’을 두고 법관 인력배치를 축소하는 등, 일본 裁判所構成法의 ‘변성모방’을 시도하고 있다. 비록 당시의 재력인력 부족으로 말미암아 법원조직 법제의 개혁이 성공에 이르지는 못했지만, 개혁 법규들이 중화민국 초기의 입법체계에 수용계승되었다는 점에서 그 법제사적 의의를 찾을 수 있다
Abstract
The legal modernization plan in the late Qing Dynasty followed the Japanese reformist line after the “Meiji Restoration.” In the course of the “Preparing Constitutionalism (Yubei-Lixian)” since 1905, the central government made some serious legal documents concerning court organization, i.e., Law of the Judgement in the Supreme Court and its Organization(Daliyuan-Shenpan-Bianzhifa) of 1906, Official Regulations of the Model Courts in Tianjin Province(Tianjinfushu-Shiban-Shenpanting-Zhangcheng) of 1907, Official Regulations of the Model Courts in China(Geji-Shenpanting-Shiban-Zhangcheng) of 1907, and Law of Court Organization(Fayuan-Bianzhifa) of 1910. I examined these four legal documents article by article, and drew some meaningful conclusions. First, although the documents rely on the Japanese court organization laws, they have their own peculiarities to save the Chinese complex situation. Second, the central government made a regional experiment of judicial reform. Tianjin province and Dongbei province were the “special judiciary zone” at that time. Third, the Court Organization Law of 1910 failed lack of finance, nevertheless, it could be highly valued as the origin of the judicial modernization in China.
