공공부문에서의 갑질은 공공기관에 대하여 영향력을 가진 주체가 부당한 요구를 하여 사적 이익을 취하면서 공적 이익을 저해하는 행위이다. 이 논문은 채용비리 사례를 활용하여 공공부분의 갑질에 대하여 게임모형으로 분석하여 개선안을 제안한다. 개선 방안에서 중요한 것은 갑에 대한 유인 변경 조치에 추가하여, 을에 대하여 갑의 부당한 요구를 거부할 수 있는 제도적 조치의 도입과 유인의 제공이다. 제도 측면에서 업무 프로세스의 개선에 추가하여 권력자의 자의적인 특혜와 보복이 어렵도록 공공부문 기관의 의사결정구조를 견고하게 확립하고 개인의 기본적 권리가 보장되어야 한다. 또한 법･제도적인 조치와 더불어 사회문화적 차원의 조치와 개인 차원의 윤리 증진도 병행되어야 한다. 특히 계몽된 이기심 정신에 따른 사회의 문화･윤리 수준을 향상시키는 것이 더 궁극적인 개선책이다.
Abstract
Gabjil in the public sphere is an act that undermines the public interest while advancing an influential party’s private interests through unfair demands on a public institution. This paper proposes a strategy to lessen the prevalence of this phenomenon by analyzing Gabjil in the public sphere using a game-theoretic model, focusing on cases of corruption in the hiring process. As a path to improvement, it is necessary to introduce institutional measures and provide incentives for public institutions to reject unfair demands when they are subjected to them. In addition to institutional measures instituted through a combination of legal strictures and the cultivation of socially beneficial virtues, measures at the social and cultural level and ethical improvement at the individual level are needed. The decision-making structure of public institutions must be clearly codified so that the arbitrary preferences and potential vindictiveness of powerful people become less prevalent and threatening. A plan to improve the level of culture and ethics in society in accordance with enlightened self-interest must be also implemented.
