본 연구는 한국공공분쟁해결에 있어서 시민단체의 역할에 대한 경험적 분석을 시도하였다. 구체적으로 본 연구는 시민단체의 개입이 공공분쟁 기간에 미치는 영향을 시민단체의 개입의 성격에 따른, 그리고 시민단체 자체의 특성에 따른 차이를 중심으로 분석하였다. 분쟁기간은 음의 값을 갖지 않는다는 특성을 고려하여 분석모형으로 음이항분회귀분석(negative binomial regression)사용하여 분석의 정확성을 제고하고자 하였다. 시민단체의 개입이 공공분쟁 기간에 미치는 영향을 분석해 본 결과 첫째, 시민단체가 공공분쟁에 개입하면 분쟁기간이 증가되며(모델 1), 둘째, 시민단체가 분쟁의 당사자나 제3자로 개입할 경우 모두는 분쟁기간을 증가시키지만 그 한계효과는 상당한 차이(당사자 = 2.4배, 제3자 = 1.473배)가 있으며(모델 2), 셋째, 시민단체의 특성이 분쟁기간에 미치는 영향도 역시 시민단체의 특성`을 불문하고 분쟁기간을 장기화시키는 요인을 작용하지만 그 한계효과에 있어서는 상당한 차이(생활형 = 1.934 배, 이념형 = 2.857 배, 생활형 + 이념형 = 2.391배)가 있다는 것을 알 수 있었다(모델 3). 특히 생활형 시민단체와 이념형 시민단체가 동시에 개입하는 경우 분쟁기간의 측면에서 볼 때 커다란 시너지 효과를 갖지 못함을 알 수 있었다. 이는 생활형 시민단체와 이념형 시민단체가 결합하여 분쟁에 개입할 때 분쟁에 커다란 영향을 미칠 것이라는 일반의 예상과 달리하는 것이라 할 것이다.
Abstract
This paper attempts to investigate to what extent the Non Government Organization(NGO)'s intervention affects the public dispute resolution. Concretely, this paper examines whether the NGO's intervention reduces the duration of the public dispute or not. For this purpose, this paper articulates an analytical framework for consisting of contextual and process factors based on Contingency Model and its central variables are evaluated against Korean Public Dispute Dataset of DanKook Center for Dispute Resolution. Using the negative binomial regression, findings are as follows: 1) the duration of the public dispute tended to be longer(Model 1), 2) when the NGO intervenes in the public dispute as a party, the duration of the public dispute increases by 2.4 times compared to the non NGO intervention, on the other hand, when the NGO intervenes in the public dispute as a third party, the duration of the public dispute increases by 1.47 times(Model 2), 3) when the ideology-based NGO intervenes in the public dispute as a party, the duration of the public dispute increases by 2.86 times compared to the non NGO intervention, on the other hand, when the interest-based NGO intervenes in the public dispute as a third party, the duration of the public dispute increases by 1.93 times(Model 3).
