세계 곳곳에서 전쟁과 분쟁이 끊이지 않고 있는 가운데 무기체계의 발달로 전투원보다 비전투원인 민간인들의 피해가 점점 커지고 있다. 본고의 연구 목적은 전시 민간인 피해가 예상되는 상급자의 불합리한 명령을 받았을 때 임무수행과 민간인 인권 보호 사이에서 어떤 선택을 해야 하는가 하는 도덕적 딜레마에 대해 살펴보고, 이러한 상황에서 군을 지휘하는 장교단에게 요구되는 덕목은 무엇인지를 알아보는데 있다. 먼저 통상적인 전쟁범죄 외에 평화에 대한 죄, 인도에 반한 죄 등의 전쟁범죄와 전쟁범죄를 예방하기 위한 전쟁법으로 제네바 협약, 헤이그 육전법규, 케롤그-브리앙 조약 등에 대해 알아보았다. 또한, 전쟁범죄에 대한 책임으로 상급자 책임론, 행위자 책임론, 범죄의도에 따른 책임론에 대해서도 살펴보았다. 사례연구로는 제2차 세계대전시 히로시마·나가사키 원폭 투하와 드레스덴 폭격, 베트남 전쟁시 미라이 양민학살에 대한 사건 개요와 시사점을 살펴보고 이를 토대로 전시 장교단이 갖추어야 할 덕목으로 충성과 복종, 도덕적 진실성, 역사적 통찰력을 제시하였다.
Abstract
As constant wars and disputes occur around the world, the development of weapon systems is causing more and more damage to civilians who are noncombatants than combatants. The purpose of this study is to look at the moral dilemma of which choice should be made between mission performance and protection of civilian human rights, and to find out what virtues are required of the army’s commanding officers when unreasonable orders were given by superiors. First, this study covered conventional war crimes, crimes against peace, crimes against humanity, and laws of war such as the laws of the Geneva Conventions, the Hague Code of War, and the Kellogg-Briand Pact. Also, as responsibility for war crimes we looked at superior accountability, agent absolute responsibility, responsibility according to criminal intentions The case study examined the overview and implications of the atomic bombings of Hiroshima and Nagasaki, the bombing of Dresden during World War II, and the massacre of Mirai in the Vietnam War. Based on this, loyalty, obedience, moral integrity, and historical insight were presented as virtues that the wartime officers should possess.
