본 연구는 1956년 제정된 후 약 70년간 유지되어 온 군진수칙의 법적·구조적·표현적 한계를 검토하고, 현대 군 관련 환경과 병력 구성의 변화, 국제규범 등을 반영한 개선안을 제시하는 데 그 목적이 있다. 군진수칙은 전투와 포로 상황에서 군인의태도를 규정하며, 단순한 행동지침을 넘어 충성과 책임의 가치를 내면화하는 상징적선언이었다. 그러나 제정 당시 냉전기의 이념적 맥락에서 만들어진 기존 수칙은 지금의 군 조직 문화나 언어 감수성과는 괴리가 크며, 법적 적용 범위, 항목 구성의 중복성, 시대에 맞지 않는 표현 등에서 개선의 필요성이 있다. 특히 법적 해석상 군무원 포함 여부, 포로 상황에서의 명령체계 유지 가능성, 국제인도법과의 정합성 문제는 중요한 재검토 과제로 남아있으며, 항목 간 중복과 비체계적 구성, 구시대적 표현은 장병들의 수용성을 저해하고 있다. 이에 본 연구는 이러한 문제의식을 바탕으로군진수칙의 개념과 역사적 배경을 고찰하고, 현행 수칙의 법적 타당성, 구조적 체계성, 언어적 수용성 등을 분석한 뒤, 교육적 실효성과 규범적 정당성을 갖춘 개선안을제시하고자 한다.
Abstract
This study examines the legal, structural, and linguistic limitations of the Republic of Korea Military Code of Conduct, which has remained largely unchanged since its enactment in 1956, and proposes improvements that align with contemporary military realities, evolving personnel composition, and international norms. Initially designed to guide the conduct of soldiers during combat and captivity, the Code functioned not only as a set of behavioral guidelines but also as a symbolic framework instilling values of loyalty, responsibility, and moral fortitude. However, the current Code—formulated in the ideological climate of the Cold War—has become increasingly disconnected from modern military culture and linguistic expectations, presenting challenges to both clarity and acceptance among service members. Key issues include the ambiguous scope of legal applicability, particularly concerning civilian personnel attached to military operations; the questionable practicality of maintaining command structures in captivity; and inconsistencies with the principles of international humanitarian law. The structure of the Code also suffers from redundancy and a lack of systematic organization, while outdated language further reduces its educational impact and normative appeal. Against this backdrop, the study undertakes a comprehensive review of the conceptual and historical foundations of the Military Code of Conduct, followed by a critical analysis of its current legal validity, structural coherence, and linguistic accessibility. Based on this assessment, the paper proposes a revised framework that modernizes the Code, ensuring that it reflects the realities of contemporary warfare, reinforces the ethical standards of a professional military, and remains consistent with international legal obligations. Ultimately, the goal is to produce a Code that not only guides behavior effectively but also serves as a credible and enduring declaration of the values that define the ROK armed forces.
