이 글에서 필자는 무형문화유산과 관련된 정책과 법을 중심으로 이루어질 수 있는 조사에 대하여 살펴보았다. 현재 이루어지고 있거나 계획되고 있는 조사의 양상과 지향을 고찰한 것이다. 이는 국가 기관의 무형문화유산 조사 정책에 한 걸음 들어가서, 필자 나름의 생각을 펼쳐보려는 의도에서 비롯된 것이다. 논의는 먼저 새롭게 시행되고 있는 「무형문화재 보전 및 진흥에 관한 법률」에 대하여 살펴보는 것으로 시작되었다. 무형문화유산과 관련한 정책의 근간이 되는 것이 「무형문화재 보전 및 진흥에 관한 법률」이기에, 이와 관련된 논의가 필수적이기 때문이다. 새롭게 법이 제정·시행이 된 이유, 새로운 법률에 나타난 특징들과한계 등에 대한 지적이 여기서 이루어졌다. 이어서 필자는 「무형문화재 보전 및 진흥에 관한 법률」을 위시한 관련 법령에서 나타난 조사 양상과 실제에대하여 고찰했다. 무형문화유산에 대한 조사 정책이 어떻게 설정되어있으며 실제 어떤 방식으로 진행되고있는가에 대한 검토를 한 것이다. 이 검토를 통하여 관련 법령에서 나타나는 무형문화유산 조사의 한계와중점 조사 편향을 지적했으며, 이를 넘어설 수 있는 몇 가지 방안도 제시했다. 끝으로 필자는 한국무형유산종합조사에 대하여 살펴보았다. 현재까지 파악된 기획 내용들을 바탕으로, 무형유산종합조사가 갖고 있는 무형문화유산 정책상의 위치와 조사 지향점을 가늠해 본 것이다. 그 결과 한국무형유산종합조사는 그 대장주의적 조사 지향성으로, 무형문화재 관련 법령에서 나타나는 모순과 아쉬움을 보완하려는 성격이 있음을 확인했다. 이러한 조사 지향점 확인에 덧붙여 필자는 실제 조사에서 유념해야 할 몇 가지 제안을 했다. 그것은 ‘과거와 현재 모두를 염두에 두는 조사 시점’, ‘당대 격변 상황을 포착할 수 있는 조사 대상 항목의 유연한 설정’,‘구체적인 조사 목적과 조사 방법의 조응과 지속적인 일관성 유지’, ‘지속적으로 조사를 관장하는 중심 기획주체의 구성’, ‘개인 조사와 구분되는 종합조사의 변별성 유지’ 등으로 정리할 수 있다.
Abstract
In this paper, I examine investigation which is contained in policies and laws of intangiblecultural heritage. Aspect and orientation of the investigation which is progressed or plannedare examined. Discussion starts with a search of the Act on Safeguarding and Promotionof Intangible Cultural Heritage. As the Act on Safeguarding and Promotion of IntangibleCultural Heritage is the basis of policies for intangible cultural heritage, discussion aboutthis law is critical. In that discussion, comments about reasons for the enactment of the newlaw, features and limits of the new policy are discussed. Subsequently, I discuss aspectsof the investigation which appear in the relevant laws. Through that discussion, I point outlimits and bias of focus investigation. And I provide measures to overcome the limitations. Inclosing, I examine the Comprehensive Survey of the Korean Intangible Heritage. As a result, Imake it certain that the Comprehensive Survey of the Korean Intangible Heritage is intendedas inventory investigation.
