Abstract
The purpose of this study is to investigate the designation situation of the dance subjectin the intangible cultural heritage law, and suggests a proper investigation method ofthe dance subject as intangible heritage. Since the Cultural Heritage Protection Act wasestablished in 1962, the preservation of intangible cultural heritage has faced a lot of issuesin the field the dance subject for 54 years. Even though the law ensured the protection andtransmission of dance and saved it from a distinction crisis, issues of monopolization andpower relations has been pointed out. Therefore, the new intangible cultural heritage law(Act on Safeguarding and Promotion of Intangible Cultural Heritage) needs to consider thenegative aspects for modification and supplementation. The main change in the new intangible cultural heritage law is change in the fundamentalprinciples. The preservation of original form in dance is very difficult because dance ispassed down from person to person and is easy to change and be reinvented during thetransmission process. The principle of preserving the original form does not take intoaccount the characteristics of dance. Therefore, the conception of maintaining the type ofdance to improve the value of intangible cultural heritage is appropriate for establishing thenational identity and developing traditional culture. Currently, 37 elements have been designated on intangible cultural heritage lists with 7on the national list and 30 on the city/province lists. Diverse views on the dance subject asintangible heritage are needed. In other words, the structure of passing down dance shouldbe considered, and it is needed to extend the scope of dance from the limited performingarts to other areas. Also, the multilateral support and funding policy is suggested topromote the dance subject.
