Abstract

The discussion on the written description requirement of a selection invention is focused on to what extent the effect of the invention should be recorded in the description of the invention to satisfy the enablement requirement. Previously, the courts recognized the inventive step of a selection invention only when it exhibits qualitatively different effect, or, substantially different quantitative effect compared to the prior art, without considering the difficulty of creating the invention. This position of the court has raised the question of to what extent the effect should be written in the description, stirring up the discussion as the above. In the case of an invention of chemical substance, there is little dispute that it is a type of product inventions and that the enablement requirement is met so long as the description of the invention discloses a chemical structural formula, manufacturing method, and the effect that demonstrates industrial utility of the substance, as these are what makes the enablement of the invention possible by means of producing and using the invention. However, although practically most selection inventions are chemical substance inventions, there are various opinions on the extent to which the effect of an invention should be stated in the description of the invention to satisfy the enablement requirement. In particular, the views that impose stricter criteria for selection inventions than ordinary chemical substance inventions, such as the one that requires quantitative description in principle when the selection invention’s effect is qualitatively homogeneous to that of the prior art in nature, perceive that a patent protection for a selection invention is given as an exception due to the selection invention’s effect that remarkably distinguishes it from the prior arts, and this effect is what gives rise to the significance and value of the selection invention. These views take the logical structure that a person skilled in the art should be able to recognize the significance and value of the selection invention through the description of the invention in order for the pertinent selection invention to fulfill the enablement requirements. Some even suggest that a selection invention is completed when the inventor discovers this effect. However, while the significance and value of a selection invention arising from the effect that remarkably distinguishes the invention from the prior art may be what justifies patent protection of the invention, the effect does not need to be recognized by a person skilled in the art to precisely understand and reproduce the invention based on the description of the invention. In addition, in the aspect of the completion of an invention, a selection invention, as a product invention, is completed when the inventor manufactures the substance having utility and confirms the existence thereof; the completion of an invention does not require the inventor to verify the remarkable effect that distinguishes the pertinent invention from the prior art. In conclusion, the remarkable effect distinguishing a selection invention from the prior art, i.e., what makes the selection invention significant and valuable, should be considered as a factor in determining the inventive step, not in fulfilling the description requirement. Therefore, in essence, a selection invention, as a product invention, should be considered to have satisfied the enablement requirement once its effect is described in qualitative terms within the scope that industrial utility is verifiable.
