학대피해아동 분리조치에 대한 검토와 개선방안

기존 경찰과 아동보호전문기관이 주도했던 학대피해아동과 행위자와의 분리를 2021년 3월 30일부터는 경찰과 시·군·구 소속의 아동학대 전담공무원이 집행하고 있다. 아동보호전문기관은 사례관리에 집중하면서, 재발방지, 홍보 등의 업무를 수행하게 되었다. 분리는 응급조치와 즉각분리로 나누어진다. 아동학대처벌법의 ‘응급조치’는 경찰과 아동학대 전담공무원이, 신설된 아동복지법의 ‘일시보호조치(즉각분리)’는 아동학대 전담공무원이 응급조치 요건에 이르지 않을 때, 집행한다. 아동기 학대피해가 미치는 부정적 영향은 많은 선행연구를 통해 입증되었고, 이에 분리가 불가피한 경우가 있다. 하지만 경찰과 아동학대 전담공무원의 이러한 분리조치가 아동을 위한 합리적 조치인지에 대해 전문가들은 의문을 제기한다. 아동비전문가인 행정실무자의 기계적 업무 집행은 향후 아동에 미치는 부정적 영향을 고려치 않는다. 아동은 학대피해보다 주 양육자로부터의 분리가 발달과정에서 더욱 부정적이라는 선행연구들을 검토해 보았을 때, 관련정책은 신속한 집행보다 선행연구의 충분한 검토와 인프라 구축이 선행된 후 시행되어야 할 것이다. 이에 본 연구에서는, 현행 학대피해아동과 행위자와의 분리조치를 검토해보고, 실효성 있는 방안을 제시함으로써, 우리나라 아동학대 예방 정책에 도움이 되는데 목적을 두었다.
Abstract
Since March 30, 2021, the separation of abused children and actors led by existing police and child protection agencies has been carried out by police, city, county, and district officials exclusively in charge of child abuse. Child protection institutions focused on case management and carried out tasks such as prevention of recurrence and promotion. Separation is divided into first aid and immediate separation. The "emergency measures" of the Child Abuse Punishment Act shall be enforced by the police and the "temporary protective measures (immediate separation)" of the newly established Child Welfare Act when the requirements for emergency measures are not reached. The negative effects of childhood abuse damage have been demonstrated through many previous studies, and separation is inevitable. However, experts question whether the separation of police officers and child abuse officials is a reasonable measure for children. The mechanical execution of administrative personnel, who are child non-specialists, does not take into account the negative effects on children in the future. Given prior studies that separation of state-care centers is more negative in the development process than abuse victims, policies should be implemented after due consideration of prior research and infrastructure construction rather than rapid execution. Thus, the purpose of this study was to help Korea's child abuse prevention policy by analyzing the meaning of the current separation measures from abused children and actors and suggesting effective measures.
