아동학대로 인한 분리조치 아동들의 경험

본 연구는 아동학대로 인해 분리된 아동이 경험하는 학대와 학대 이후의 분리과정, 분리 보호 환경 등을 살펴보았다. 이를 위해 학대로 인해 분리 되어 아동보호시설에서 보호되고 있는 아동 3명과 아동의 보호자 3명을 대상으로 심층면접을 실시하였다. 본 연구결과는 분리보호 전, 분리보호 과정, 분리보호 이후로 분석하였다. 아동이 가정에서 분리되기 전의 아동은 부모와의 애착관계 회복이 어려울 정도로 부모로부터 심각한 학대를 받고 있었다. 분리되는 과정에서 아동은 기대나 희망을 잃고 버림받았다는 생각을 하게 되었다. 아동을 분리하고 보호체계를 결정하는 과정에 아동이나 가족의 의사를 묻지만, 여전히 아동에게 필요한 보호체계를 결정하는 과정에 제대로 참여하지 못하고 있다. 한편, 최적의 아동 보호체계를 결정하기에는 보호 인프라가 미흡하고, 아동을 담당하는 담당자에 따라 보호체계 결정에 격차가 있는 것으로 나타났다. 분리된 아동은 원가정뿐만 아니라 다니던 학교, 친구, 친인척들로부터 단절되어 있으며, 가정 외 보호로 인해 교육적, 물리적, 문화적 연속성이 유지될 수 없었다. 처음 아동이 보호체계에 편입되면 기본적인 생활조차 힘들지만, 일정 기간이 지나면 아동은 긍정적으로 변화되었다. 아동의 원가족 복귀를 위해 소통 및 교류 등의 기회를 지원하지만, 부모의 형편상 아동과 소통 및 교류는 원활하지 못하였다. 본 연구 결과를 바탕으로 가족지원 서비스 체계 구축, 아동분리조치 과정과 보호 과정에서 아동의견 표현과 청취 등의 참여권이 보장, 아동분리조치 이후 아동의 생활환경 유지 관련 규정 마련, 원가족 복귀를 위해 아동분리보호 직후 부모 및 가족과의 관계 프로그램 등이 이루어질 수 있도록 아동보호서비스 인프라 구축하고, 분리보호체계에 아동을 보호하는 것이 아니라 아동 상황에 맞춰 아동을 보호할 수 있는 지원이 이루어 질 필요가 있다.
Abstract
This study examined the separation process after abuse and abuse experienced by children separated by child abuse, and the separation protection environment. To this end, in-depth interviews were conducted with three children separated by abuse and protected in child protection facilities and three guardians of the children. The results of this study were analyzed before separation protection, after separation protection process, and after separation protection. Before the child was separated from the family, the child was seriously abused by the parents to the extent that it was difficult to restore the attachment relationship with the parents. In the process of separation, children lost their expectations or hopes and came to think that they were abandoned. The child or family's intention is asked in the process of separating children and determining the protection system, but they are still not properly participating in the process of determining the protection system necessary for children. On the other hand, it was found that the protection infrastructure was insufficient to determine the optimal child protection system, and there was a gap in the decision of the protection system depending on the person in charge of the child. Separated children are disconnected from schools, friends, and relatives who attended as well as Won Won-jeong, and educational, physical, and cultural continuity could not be maintained due to non-family protection. When a child is first incorporated into the protection system, even a basic life is difficult, but after a certain period of time, the child has changed positively. Opportunities such as communication and exchange are supported for children's return to the original family, but communication and exchange with children were not smooth due to parents' circumstances. Based on the results of this study, it is necessary to secure the right to participate in the process of establishing a family support service system, expressing and listening to children's opinions, and preparing regulations on maintaining the living environment after child separation.
