현 법적 체제하에서의 온라인 중재의 허용성

온라인 중재의 출현과 성장으로 현재의 법률체계에서 전자적 수단의 이용에 의해 수행되는 중재가 유효한지의 여부에 관한 문제에 관심이 증가하고 있다. 본 논문은 온라인중재절차에 에 놓여 있는 잠재적인 문제점을 도출하고 있다. 온라인중재의 구조는 동일한 법률체계 하에서 존재하는 전통적인 중재의 새로운 차원을 구성하고 있다. 발생되는 법적 문제들은 온라인중재의 적용과 장래에 이겨내기 어려운 장해를 구성하지 않을 것이다. 따라서 결국 온라인 중재가 국제상사중재의 체제 내에서 중요한 현상이 될 것이라는 합의가 문헌들에서 찾아볼 수 있다. 그러나 단기적으로 많은 저자들은 어떤 불실성이 존재한다고 주장하면서 회의적인 경향을 보이고 있다. 본 논문에서 비록 온라인중재와 관련된 법적 문제의 모두가 쉽게 해결될 수는 없지만 현재의 법률체계 하에서 그리고 국제상사중재의 제도 하에서 온라인 중재에서 이겨내지 어려운 법적 장해는 없을 것이다.
Abstract
The emergence and growth of online arbitration practices resulted in the increasing interest in the question of whether an arbitration conducted by the use of electronic means is valid within the current legal framework. This article outlines potential obstacles lying in the path of online arbitration. Online arbitration schemes constitute a new dimension of traditional arbitration, existing within the same legal framework. The arising legal problems do not constitute insuperable obstacles to the application and further growth of online arbitration. Thus far, there seems to be agreement in the literatures that in the long run, online arbitration will prove to be an important phenomenon within the regime of international commercial arbitration. However, in the short run, many authors tend to be sceptical, arguing that some uncertainties remain. In this article, although all of the legal difficulties arising with regard to online arbitration may be not easily resolved, there are not insurmountable obstacles to online arbitration within the current legal framework and regime of international commercial arbitration.
