현재 인터넷은 개방형 네트워크로 국제거래에서 상거래 활동과 관습을 변화시키고 있다. 국내 전자상거래는 매년 급속도로 증가하고 있으며, 전자상거래로부터 발생하는 분쟁 또한 증가하고 있다. 그러나 이러한 분쟁발생을 해결하기 위한 해결방안은 확립되어 있지 않다. 신속한 분쟁해결을 장점으로 하는 온라인 분쟁해결 시스템이 최적의 모델이 될 것이다. 온라인 분쟁해결은 편리성, 저비용, 재판관할권 문제의 회피와 같은 많은 이점을 가지고 있다. 본 논문의 목적은 국제거래에서 분쟁해결방법으로서 온라인 분쟁해결의 유형과 문제점을 검토함으로써 좀 더 효과적이고 효율적인 분쟁해결을 위해 온라인 분쟁해결을 촉진하는데 기여하는 것이다.
Abstract
Nowaday, internet as open network is changing all of the commercial practices and customs in international transaction. Every year the domestic e-commerce transactions using the internet rapidly increase and the conflicts resulted from the e-commerce largely grow. But dispute resolution method is not established to settle these disputes. The On-line ADR system having speedy resolution as its advantage will be the optimized model. On-line Dispute Resolution has many advantages such as convenience, low-cost and avoidance of jurisdiction issues. The purpose of this paper contribute to promote the On-line Dispute Resolution for more effective and efficient dispute settlements by reviewing the types, problems of On-line Dispute Resolution, as the dispute settlement way in international transaction.
