ODR은 그동안 이메일이나 채팅에 기반을 둔 시스템의 방법으로 제한되어 온 기술적 한계 때문에 상대적으로 열악하다는 제약을 받아왔다. 조정에 관한 한, 이러한 이메일이나 채팅에 기반을 둔 비동시적 방법들은 생생한 면대면 조정방법에 비해 여러 가지 이유로 인해 그 경쟁력이 떨어지는 것처럼 보인다. 본고에서는 이러한 전통적인 문서기반의 ODR에 비해 동시적 시청각 ODR의 장점을 중심으로 검토하였고, 또한 조정인의 역할에 관하여 논의하였다. 특히 본고에서는 문서기반 ODR방법의 단점들을 극복하면서 온라인상에서의 기존의 전통적인 면대면 만남과 유사한 방법을 서비스 해주기 위해 2008년 1월부터 AADROL사에 의해 개발․운영되고 있는 “동시적 수단의 시청각 온라인 조정방법(SAOIMM)”을 중점적으로 검토하였다. 결론적으로, SAOIMM의 제시되고 있는 단점들은 그리 중요하지 않은 것으로 나타났다. 반면에 SAOIMM은 격지자간의 만남을 위해 당사자들이 여행할 필요 없이 온라인상에서 실시간으로 그들의 조정을 통한 분쟁해결이 가능하도록 해주는 동시적 온라인 시청각 조정방법을 제공해주고 있으며, 그 결과 시간과 비용을 절약해주고, 스트레스를 최소화시켜 주며, 또한 보안유지 및 실질적인 친환경적 혜택을 제공해주는 것으로 나타났다. 그리고 이러한 방법의 조정에서는 특히 조정인의 역할이 매우 중요한 것으로 나타났다.
Abstract
ODR has been until now confined to the relative sidelines because of technological limitations, which have generally restricted ODR to email and chat-based systems or methods. At least in the case of mediation, these emails and chat-based asynchronous methods seem to be less than competitive for a variety of reasons when compared to live, face-to-face mediations. This article describes the benefits of synchronous audiovisual ODR verses traditional text-based ODR and the role of mediators. Especially this article examines the business method called "synchronous audiovisual online immediate mediation method (SAOIMM)", which has been developed and placed in operation by AADROL Inc., starting in January 2008, to provide an online analog to the traditional old fashioned face-to-face meeting while avoiding the shortcomings of strictly text-based ODR. In conclusion, the supposed disadvantages to SAOIMM are demonstrated to be relatively immaterial. On the other hand, SAOIMM provides a business method for synchronous audiovisual online mediation which enables parties at remote distance to mediate together in real time, online without the need of traveling to a remote location to meet face-to-face, thus saving time and expense, minimizing stress, enhancing security and providing a substantial environmental benefit. And this article reviewed the importance of the roles of mediators.
