본 연구의 목적은 원지시인의 거래은행과 수익자의 거래은행간에 자금이체에 따른 주요쟁점을 비교하는 것이다. 본 연구의 목적을 달성하기 위하여 미국 통일상법전 제4A편, 자금이체시스템규칙, 그리고 일부 법원판례를 인용하였다. 본 연구는 다음과 같은 내용으로 진행되었다. 첫째, 계약자유의 원칙에 따라 미국 통일상법전 제4A편의 일부 조항들이 당사자간의 약정으로 변경가능한지에 대하여 고찰하였다. 둘째, 지급지시의 이행과 관련하여 지급지시의 취소와 정정, 지급지시의 이행실패와 자금환급보증규정, 임시적 지급과 유효성, 손실분담약정과 최후심판일 원칙을 중심으로 원지시인의 거래은행과 수익자의 거래은행의 책임을 상호비교 분석하였다. 셋째, 양 은행의 승낙시점을 구별하여 면책시점을 상호 비교하여 고찰하였다. 그리고 마지막 결론에서는 한국 전자자금이체의 정착과 발전을 위한 정책적 시사점을 제시함으로써 마무리를 하였다.
Abstract
The purpose of this study is to comparative research in related to funds transfer between originator’s bank and beneficiary’s bank. I attempted a literature reviews together with U.C.C. 4A, regulations(agreement) and diverse juridical precedents to achieve this research’s purpose. The results of this paper are as follows. First, the provisions of Article 4A are variable by agreement of the affected parties, favoring freedom of contract. Secondly, in connection with execution of payment order, I research on application of cancellation and amendment of payment order, execution failure and the money-back guarantee, provisional payment, and loss-sharing agreement and doomsday situation between both banks. Thirdly, I comparatively study discharge time between originator’s bank and beneficiary’s bank. Lastly, as a result this paper suggest a policy assignment for development of electronic funds transfer system in the future.
