Abstract
This article proposes a reconceptualization of legal personhood in response to the challenges of the Anthropocene and the digital transformation era. Traditional models of legal personhood grounded in human rationality, autonomy, or institutional functionality, are increasingly insufficient in addressing the rights and governance of nonhuman entities such as ecosystems, artificial intelligence, and future generations. The article first critiques the philosophical and functional foundations of legal personhood, then analyzes comparative legal experiments, including those in Ecuador, Colombia, and New Zealand that expand personhood to nonhuman subjects. It further argues that fragmented national approaches highlight the need for transnational governance frameworks. As a normative and institutional alternative, the paper proposes the theory of Public-Purpose Legal Personhood, a pluralist model that allocates varying degrees of legal recognition based on ecological interdependence, vulnerability, governance necessity, and symbolic value. This approach aims to provide a principled, adaptive, and globally resonant framework to advance legal responses to the ecological, ethical, and technological challenges of our time.
