Abstract
In modern copyright law, which began with Queen Anne’s Law, the author plays a very important role as the subject of the work. As such, identifying the author’s identity is a matter of priority. As science and technology advances, granting author status to anyone has been discussed under copyright law since Burrow-Giles Lithographic Co. v. Sarony in 1884, and the development of artificial intelligence technology is again an issue of legal issues concerning the confirmation of author status of artificial intelligence products. Though it was thought that artificial intelligence products should be protected by law, the problem is that only creations expressing human thoughts or emotions can be protected under the current copyright law. In addition, only human beings can be recognized as authors in precedents and theories. This paper introduces the author problem of the distant, recent issue of artificial intelligence products. and review the author’s concept through content on the author’s concept of Anglo-American and continental law countries. It also looks at each opinion (artificial intelligence, programmer, user, co-author, investor, and public domain) to give author status to an artificial intelligence product and to learn about legislation in this regard. The conclusion is also most relevant if the user is given the author status. There is a reason for all the theories about the possible subject of artificial intelligence products, but no matter how advanced artificial intelligence is in the current legal system, it is difficult to give the author status. The opinions given to programmers and co-authors have their own advantages, but they also represent new problems. It is almost impossible for an investor to recognize his or her identity as a writer without participating in the creation process himself. Entering the public domain violates the ultimate purpose of copyright law and is also disadvantageous for creation. Acknowledging programmers and investors can give double incentives and lead to the use of inequality in artificial intelligence. But the trend limits the incentive to put resources into the future development of artificial intelligence, which works against programmers and investors. Co-authors may create problems with new collaborative or combined works, so it seems to avoid problems rather than include them in co-authors because they have some advantages, but they represent new problems. Included in the public domain violates the basic purpose of copyright law, and the number of works of value to the public is reduced. In addition, it can cause inconvenience and confusion for users and the problem of orphan crops can reappear. Therefore, granting a user of an artificial intelligence product the author status avoids inhumane problems, and then the user directly participates in the creation process. Finally, it can encourage authors and promote re-creation. In other words, it is most appropriate for a user to be regarded as the author of an artificial intelligence product.
