1951년 파리조약 이래 유럽연합(EU)은 다섯 차례의 조약개정을 거치면서, 유럽을 하나의 통합된‘연방국가’로 진행시키고 있다. 이러한 통합과정 즉, EC에서 EU로 이어지는 모든 협상이 조약으로 기초되었다. 이러한 조약은 국민투표 또는 국민의 대표기관인 의회의 비준을 거쳐 EU국민들의 합의를 도출하였으며, 이를 바탕으로 유럽연합의 국가성은 완성되고 있다. 이러한 유럽연합의 국가성 문제는 EU의 법인격 부여 문제, 회원국에 대한 통치작용 문제 그리고 EU의 준연방적 국가형태문제 등 다양한 관점에서 분석될 수 있다. 이에 본고는 제기된 세 가지의 문제를 규명하는 것을 목적으로 한다. 이러한 문제규명은 초국가공동체의 국가성을 분석함으로써‘유럽행정연구를 위한 토대가 될 뿐만 아니라, 향후 형성가능성이 있는‘동북아공동체’또는‘동북아연합의 형성을 위한 기초연구로서 의미가 있을 것이다.
Abstract
The Developments in the European Union(EU) since the mid-1980s have generated considerable debate on the dynamics of the pooling of sovereignty and concomitant reductions in the authority of national governments. While most attention has been paid to the EU‘s internal market and monetary integration, its legal system is the clearest manifestation of burgeoning surpanationalism. This study aims to trace and analyze stateness of the European Union. In particular, this study is to examine the legal personality of European Union and its relationship to the way in which power is divided within the European Union.
