최근 우리나라는 한-칠레 FTA를 비롯하여 한-미 FTA 타결에 이르기까지 동시다발적으로 FTA 체결을 확대시켜왔으며, 현재도 EU, 인도, 캐나다 등과 FTA 체결을 위한 협상을 진행 중에 있다. 그런데 이와 같은 FTA의 이행과정에서 실질적으로 그 효과를 극대화하고 역외물품으로부터 산업을 보호할 뿐만 아니라 간접적으로는 기업의 투자 및 생산방식에 미치는 영향이라는 측면에서 가장 핵심적인 분야가 바로 원산지규정이다. 그러나 FTA의 급증은 긍정적인 효과뿐만 아니라 부정적인 문제를 야기하는데, 그것은 바로 FTA 체결이 증가하면 할수록 원산지규정을 적용하는데 있어서의 복잡성이 증가한다는 것이다. 즉, FTA 체결 확대에 따른 스파게티 볼 효과로 인해서 행정적, 경제적 비용이 증가하고 이러한 비용의 증가는 FTA로 인한 경제적 효과를 반감시키는 역할을 한다. 따라서 정부측면에서는 원산지정보 관리를 위한 제도(생산공장보유업체지정제도, 수출자인증제도)의 적용을 확대하고 원산지정보관리 전담기관을 설립함으로써 구매, 생산, 판매에 이르는 기업의 생산프로세스와 원산지증명 및 검증에 이르는 행정적 절차를 모두 포괄하는 관리방안을 마련해야 하며, 기업측면에서는 FTA 원산지규정에 대한 이해와 더불어 필요성에 대한 인식제고를 통해 기업차원의 원산지관리시스템을 구축하여 원산지정보 관리의 효율성과 투명성을 극대화해야 할 것이다.
Abstract
Rules of origin(RoO) play a major role in the international trading system and constitute an indispensable component of any discriminatory arrangements. The primary aim of RoO is to ensure that preference accrue only to the signatories of a free trade agreement, they are often complex and can act as a barrier to trade. The RoO can affect trade by inflicting two types of costs - production and administrative costs. Therefore, in the presence of a stringent RoO, the potential for FTAs to boost intra-trade between the members will likely be moderated by the rise in the cost of inputs. On the other hand, a less complicated RoO stimulates trade between regional partners by reducing the transactions costs of such trade. Recently, The Korea is contracting FTAs at the same time the several country. Therefore, solve complexity of Korea's FTA rules of origin and to maximize FTA effect, FTA origin information should be managed. Thus, In this paper analyse a implication of Korea's FTA RoO focused on the three fold : (1)overview of the objectives, types, effects of RoO in principles and Korea's FTA; (2)difference of regulation between fta does comparative analysis and examine Spaghetti Bowl effects; (3)offer an appropriate plans to RoO information Management. Conclusively, Government must expand application of system(factory registration, exporter certification) for place of origin information administration and must establish place of origin information administration complete charge institution for government official plan preparation that include all company's production process and administrative formality. On the other hand, Companies must raise realization about necessity along with comprehension about FTA place of origin regulation and constructs place of origin executive system of enterprise dimension and may have to maximize efficiency and lucency of place of origin information administration.
