Abstract

Amid a global surge in forced migration, international refugee regimes have primarily focused on the treatment and rights of individuals after obtaining refugee status, while discussions regarding asylum seekers, who are waiting for their refugee status to be determined, remain limited. Asylum seekers often find themselves in institutional and social protection gaps, unable to access even basic health services. This study aims to examine the structural limitations of the international refugee regime and, building on this foundation, analyze the regional protection frameworks in Latin America and Mexico's refugee laws and policies. Using the Mexico-Guatemala border region as a case study, this research evaluates how asylum seekers access healthcare services and assesses the role of international and regional protection systems, as well as Mexico's refugee laws, in realizing universal health rights. The findings reveal that while refugee protection systems focus on the rights of individuals after obtaining refugee status, they lack concrete and practical measures to ensure the fundamental rights of asylum seekers, particularly their right to health. This highlights the inability of international protection systems and regional policies to address the legal and institutional gaps. Furthermore, this study analyzes the structural health inequalities faced by asylum seekers from international, regional, and national perspectives and underscores the need to strengthen legal and institutional frameworks to enhance their protection. The precarious health rights situation of asylum seekers in Mexico’s border regions serves as a symbolic example of the structural deficiencies of the international refugee regime, indicating that this issue is not confined to Mexico but reflects a broader global challenge.
