최근 교육부가 학교안전사고에 대한 관계법을 제정하려는 계획을 발표하고 입법절차까지 예고하였다. 본 논문은 이러한 계획의 실행단계에서 현행 학교안전사고에 대한 특성과 문제점을 분석하고 그 대안을 제시하면서, 앞으로 나타날 학교안전사고관계법의 제정방향을 논리적이고 체계적으로 연구한 것이다. 본 연구에서는 우선 학교에서 안전사고가 발생했을 경우, 그 사고를 둘러싼 당사자들의 책임이 어떠한가에 대하여 살펴보고, 그 책임의 법적 근거들을 아울러 고찰하였다. 그리고 학교안전사고에 대하여 현재 유일한 제도적 보상장치인 학교안전공제회 제도가 가진 조직 및 운영의 실태와 보상금지급규정 등에 관한 문제점을 분석하였다. 그리고 그 문제점을 중심으로 하여 그에 대한 對症的 解決策을 제시하는 것이 아니라 代案的 接近을 통해서 개선방안을 모색하였다. 아울러 이러한 대안제시 속에 최근 논의되고 있는 학교안전사고에 대한 관련법 제정의 방향을 언급하면서 앞으로 해결해야 할 과제들을 함께 논하였다.
Abstract
The Ministry of Education recently proclaimed that the related laws to the accident at school will be enacted in the first half of 2004. The purpose of this paper is to analyze the characteristics and problems of the accident at school and to present an alternative plan to the problems. And also this is to examine the directions of enacting the related law to the accident at school logically and systematically. First, this paper is to investigate what the responsibilities of the party concerned are, and what the legal bases of the responsibilities of them are, when the accident at school occurs. Second, this research is to examine the realities and problems of the structure, the management, and compensation granting rules in the Mutual Aid Fund for the Safe School(MAFSS), which is presently a unique system for the accident at school. Third, this is to grope for remedies through the alternative approach against the problems of the structure and the management in the Mutual Aid Fund for the Safe School(MAFSS).
