학교폭력 피해학생 보호를 위한 입법정책의 방향

Abstract

Although it has been debating school violence for years, there are lack of active measures to protect victims of school violence effectively. Therefore, this study aims to deduce and suggest several legislations and policies to support victims and take actions necessary for offenders. In order to protect the victims effectively, it is necessary to take the following propositions. First, qualified and professional counselors should be put into schools to support victims and offenders. Second, it is necessary to care the victimized students in a timely manner and support the enough financial aid and treatment. Third, it should be required to set a time limit for principals to carry out the action of school violence countermeasure autonomous committee. Furthermore, principals should submit reasons in writing if they do not carry out the action. Fourth, it is necessary to reintroduce suspension from school and introduce the action of transferring compulsively to another school for offenders in the elementary or secondary school. Lastly, different types and levels of penalties should be imposed based on cruelty or repetition. Additional penalty can be given if a student attacks a handicapped student, violates the measurement for 'prohibiting of action of contact, threat, or revenge' to the victimized, or repeats the violence at school.
